
The regular meeting of the Board of Trustees of the Village of Arcade, Wyoming County, New York was held on Tuesday, September 6, 2005 at 7:00pm there were:

Pursuant to Article 7 of the Public Officers Law, notice of this meeting was given to the media on the 24th day of August 2005 and the same posted on the 24th day of August 2005.

Mayor Doster opened the meeting with the Pledge to Allegiance.
APPROVE MINUTES
Motion by Trustee Burkett and seconded by Trustee Ely, the minutes from the regular meeting held on August 16, 2005 be approved as presented by the Clerk.

ARCADE VILLAGE PARK HOCKEY RINK
Several Board members met at the Village park hockey rink prior to this meeting to inspect the repairs discussed with Kris Little, League President, at the July 5, 2005 Village Board meeting. The observation determined that repairs are still required. Superintendent of Public Works Kilburn was directed to compose written correspondence to the league and advise them of the observations and the need to comply prior to the league start.
VILLAGE PARK CABIN RENOVATIONS GRANT
Mayor Doster advised the Board and attendees that the Town of Arcade would be administering the grant funds since the grant was awarded to them. Mayor Doster continued to state that the Village of Arcade (VOA) owns the cabin, therefore, the VOA Board of Trustees must approve all renovations prior to the start of any and all projects pertaining to this grant.
PERMISSION TO CARRYOVER VACATION
Motion by Trustee Reisdorf, seconded by Deputy Mayor Kosmerl, and unanimously carried permission be granted for Lois Matuszak to carryover 40 hours of vacation past her anniversary date of September 13, 2005 to be used within 60 days of said anniversary date due to unforeseen office staff shortages.
RESOLUTION – EMPIRE ZONE APPLICATION
The following resolution was offered by Mayor Doster and seconded by Deputy Mayor Kosmerl:
RESOLUTION
WHEREAS, Section 961 of Article 18-B of the General Municipal Law authorizes application by Wyoming County for designation of certain areas as an Empire Zone within the meaning of said statue; and
WHEREAS, such designation could greatly benefit Wyoming County in that new businesses would be encouraged to locate in the zone area, existing businesses would be encouraged to expand in the zone area and new and expanded businesses would generate new jobs for Wyoming County residents; and
WHEREAS, Wyoming County intends to authorize the submission of an application for the designation of areas within the Village of Arcade as an Empire Zone; and
WHEREAS, the Village of Arcade wishes to designate certain areas within the Village of Arcade as part of the proposed Empire Zone; and
WHEREAS, the Village of Arcade is desirous of working with Wyoming County through the Empire Zone Program to provide enhanced job opportunities for its residents; and
NOW, THEREFORE, BE IT RESOLVED, by the Village Board of the Village of Arcade, New York, that it fully supports and concurs in the submission of an application by Wyoming County for the designated of certain areas as an Empire Zone.

RESOLUTION - TAX COLLECTION BY WYOMING COUNTY
The following resolution was offered by Deputy Mayor Kosmerl and seconded by Trustee Burkett:
RESOLUTION
WHEREAS, Wyoming County adopted Local Law No. 12 of the year 1994 Providing for the Collection of Certain Delinquent Village Taxes by the County of Wyoming; and
WHEREAS, any Village lying within the County of Wyoming may elect each year to have its delinquent Village taxes collected by the County of Wyoming in accordance with Section 1442 of the Real Property Tax Law of the State of New York; and
WHEREAS, any Village must request by resolution to have the County of Wyoming collect back taxes, said resolution to be adopted no earlier than September 1 of each year and a certified copy filed with the County Treasurer and the Clerk of the Board of Supervisors by October 1 of the same year;
NOW, THEREFORE, BE IT RESOLVED, that the Village of Arcade elects to have its delinquent Village taxes collected by the County of Wyoming and that such list of unpaid taxes and certificate of delinquencies will be prepared and delivered to the Real Property Tax Department by November 15th.

RESOLUTION – AUTHORIZATION TO SIGN INTERNET BANKING ENROLLMENT
The following resolution was offered by Trustee Ely and seconded by Mayor Doster:
RESOLUTION
RESOLVED, that the Village of Arcade is authorized to enroll for Bank of Castile Internet Banking, and that Pamela J. Beiersdorf, Clerk/Treasurer and Janet R. Payne, Deputy Clerk/Treasurer are hereby authorized to execute Internet Banking Enrollments, and/or other agreements that may be required for the Internet Banking services requested, on behalf of the Village of Arcade, in such form and content and upon such terms as deemed suitable and proper. The Village of Arcade Board will designate different or additional individuals as authorized representatives of the Village of Arcade in accordance with the Internet Banking Enrollment, if needed.

WYOMING COUNTY VILLAGE ASSOCIATION MEETING
Motion by Deputy Mayor Kosmerl, seconded Trustee Burkett, and unanimously carried permission be granted for the Mayor, Deputy Mayor, Trustees, Superintendent of Public Works, Police Chief, and Clerk/Treasurer to attend the Wyoming County Village Association meeting on Wednesday, September 21, 2005 beginning at 6:30pm at the Warsaw Legion Hall. The planned guest speaker for the evening is Daniel Burling presenting information on the Empire Zone.
RESOLUTION – LOCAL LAW CHAPTER 37, "PARKS"
The following resolution was offered by Trustee Burkett and seconded by Mayor Doster:
RESOLUTION
WHEREAS, the Arcade Village Board has recommended that the Village of Arcade amend Chapter 37 of the Laws of the Village of Arcade entitled Parks to more clearly define the application process, and
WHEREAS, the Village has a fee schedule, all such fees for use of the park shall be moved to and be included on the fee schedule maintained by the Village of Arcade, and
WHEREAS, a draft copy of the proposed Local Law No. 3-2005 amending Chapter 37 Parks was reviewed by each Board member at the board meeting held on September 6, 2005,
NOW, THEREFORE, BE IT RESOLVED, that the Board publish Notice of Public Hearing to be held in accordance with the provision of Section 20 of the Home Municipal Rule Law, to be held on the 20th day of September, 2005 at 7:00 p.m. in the Village Board Room, 17 Church Street, Arcade, New York, at which time all interested persons will be heard.

PROCLAMATION FOR JOANNE E. OFFERS
Motion by Deputy Mayor Kosmerl, seconded by Mayor Doster, and unanimously carried the Board approves the proclamation for Joanne E. Offers as follows:
WHEREAS, the Village Clerk maintains custody of the Village seal, books, records and papers of the village and all the official reports and communication of the Board of Trustees and;
WHEREAS, the Village Clerk ensures that meeting minutes of the Board of Trustees are prepared correctly and timely and;
WHEREAS, the Village Clerk files, publishes, posts notices relating to resolutions, local laws, public hearings, open meetings, and referenda and;
WHEREAS, the Village Clerk maintains all Village resolutions and local laws and;
WHEREAS, the Village Clerk prepares, signs, and transmits to the treasurer an order directing the treasurer to pay all claims ordered paid by the Board of Trustees and;
WHEREAS, the Village Clerk produces books, records, and papers for inspections and;
WHEREAS, the Village Clerk administers the oath of office to Village officers and;
WHEREAS, the Village Clerk maintains postings which are required to be on permanent display and;
WHEREAS, the Village Clerk notifies the proper State and municipal officials of Village business and;
WHEREAS, the Village Clerk serves as the point of contact for citizens with questions about the Village and;
WHEREAS, the Village Clerk acts as the liaison between the citizens and the Village Board of Trustees and;
WHEREAS, the Village Clerk serves as the chief election officer for the Village election and:
WHEREAS, the Village Clerk serves as the Registrar of Vital Statistics and;
WHEREAS, the Village Treasurer acts as the chief fiscal officer of the Village and;
WHEREAS, the Village Treasurer maintains custody of all Village funds and keeps account of all Village receipts and expenditures in compliance with the uniform systems of accounts issued by the Office of the State Comptroller and;
WHEREAS, the Village Treasurer is an authorized signatory of Village checks and;
WHEREAS, the Village Treasurer is appointed as the Village budget officer and responsible to prepare the tentative budget and;
WHEREAS, the Village Treasurer is responsible to file an annual financial statement of the Village's revenues, expenditures, and outstanding indebtedness annually at the end of the fiscal year to the State Comptroller and;
WHEREAS, Joanne E. Offers, has served as the Village Clerk-Treasurer for the Village of Arcade for the past 22 years;
NOW, THEREFORE BE IT RESOLVED THAT I, Michael R. Doster, Mayor of the Village of Arcade, in recognition of her outstanding and continued contributions to the people of this Village, Town, County, and State and in deep appreciation of her dedicated and tireless services whenever or wherever they were needed,
DO HEREBY PROCLAIM September 15, 2005 to be JOANNE E. OFFERS DAY in the Village of Arcade, in the State of New York and;
BE IT FURTHER RESOLVED THAT I, Michael R. Doster, Mayor of the Village of Arcade, earnestly request the citizens of our community to join in this observance.
Also, carried by the preceding motion, permission has been granted to publish an abridged version of the above proclamation in the Arcade Herald the week of September 12, 2005
BUDGET ADJUSTMENTS
Motion by Trustee Reisdorf, seconded by Deputy Mayor Kosmerl, and unanimously carried the following budget adjustments be approved as presented by the Clerk.
AUDIT BILLS
Motion by Mayor Doster, seconded by Trustee Burkett, and unanimously carried the Village bills be audited and paid and that the Clerk be granted permission to transfer funds from the money market accounts to the checking accounts to cover such bills.
PERMISSION TO HIRE SEWAGE TREATMENT PLANT TRAINEE
As recommended by Superintendent of Public Works Kilburn, a motion was made by Mayor Doster, seconded by Trustee Burkett, and unanimously carried to hire Andrew Bartz, a Village Resident, as Waste Water Treatment Plant Trainee effective September 26, 2005 at a beginning hourly rate of $13.05.
VOA EMPLOYEE RETIREMENT INCENTIVE
Superintendent of Public Works Kilburn distributed a draft copy of a proposed employee retirement incentive for Board review. Further discussion will take place at the next Board meeting scheduled for September 20, 2005.
SCHEDULED POWER OUTAGE
Superintendent of Public Works Kilburn informed the Board of a scheduled system-wide electric outage for Sunday, September 18, 2005. The outage will begin at 7:00am and should not exceed 5 hours. Should the weather prevent the work from taking place on this date, the outage will occur on Sunday, September 25, 2005 at 7:00am. The outage is required to safely work on the tap switch, transmission line, and substations, hereby preventing future, unscheduled outages. Arcade electric customers will be notified by mail of the scheduled outage.
STATUS - PICK-UP TRUCK FROM STATE CONTRACT – HIGHWAY DEPARTMENT
Upon receipt of verbal confirmation from the State, Superintendent of Public Works Kilburn was advised to submit a purchase order and indicate that the purchase is contingent upon maintaining the same price as the 2005 contract. The purchase order is for a new 2006 Chevy 1500, 4 x 2, pick-up truck from State contract at a price of $11,717.00 for the Highway Department.
DOWNTOWN AREA SPEED STUDY
As noted in the July 5, 2005 Village Board meeting minutes, Superintendent of Public Works Kilburn and members of the Board attended a meeting with Department of Transportation (DOT) on June 21, 2005. As a result of the meeting, the DOT had several actions including a downtown area speed study. Trustee Ely asked Superintendent of Public Works Kilburn to contact the DOT via written correspondence for a status of this study.
CRYSTAL INN BUILDING
Demolition of the old Crystal Inn building is scheduled to begin the week of 09/12/05 and is expected to take two (2) days. Parking in that area will need to be restricted.
GLENN COOPER, NORTH STREET
The Board received a draft copy of an investigative report issued by Leonard J. Morse-Fortier, Senior Project Manager to St. Paul Traverlers regarding a claim of water damage to property of Mr. Glenn Cooper, North Street, Arcade, New York. Deputy Mayor Kosmerl requested that Board members review the report and associated pictures and be prepared to discuss further actions at the next meeting scheduled for September 20, 2005.
PERFORMANCE OBJECTIVES/GOALS REQUESTED
The Board requested that the Superintendent of Public Works, Police Chief, and Clerk/Treasurer develop objectives and/or goals for the upcoming months. They are due to Board members by the end of September.
