At a regular meeting of the Board of Trustees of the Village of Arcade, Wyoming County, New York held on Tuesday, September 21, 2004, at 7:00 P.M. there were:

Mayor Doster opened the meeting with the Pledge to Allegiance.

APPROVE MINUTES

Motion by Trustee Kosmerl and seconded by Deputy Mayor Ely the minutes from a regular board meeting held on September 7, 2004 be approved as presented.  The motion was approved by the following vote:

EXECUTIVE SESSION

Motion by Mayor Doster, seconded by Trustee Reisdorf and unanimously carried the board enter executive session to discuss current litigation.

Motion by Trustee Kosmerl, seconded by Trustee Reisdorf and unanimously carried the board exit executive session.

AWARD BID – BELT FILTER PRESS

Superintendent Kilburn and Foreman Burkett are still trying to get the cost of the project below the budget amount of $150,000. If this is not possible Superintendent Kilburn will recommend re-bidding at the October 5, 2004 board meeting.

ARCADE AREA PARTNERHIP - UPDATE

Phil Antonio addressed the board with an update on their committee.  They had a meeting with various people from the county to give them guidance. He feels that since the inception of the committee there has been more communication between the various groups.  They are still in the process of setting their goals and projects.  One issue that is of major concern is the traffic on Route 39.  They would like to see flashing lights by the school indicating a school zone and possibly put lights on the pedestrian crossing signs to help slow down traffic. Someone in the audience mentioned that it’s the mentality of the people you can’t change.  Deputy Mayor Ely informed the group that the Village has tried to work with the DOT on various means to slow down the traffic and that the wheels of progress move slowly. Mr. Antonio was asked to sit in on the next meeting with the DOT.

NORTH STREET RESIDENTS – WATER PROBLEMS

A group of concerned citizens from North Street addressed the board regarding water run off from the Douglas Drive Apartments. The water is draining onto their property and causing severe damage to their garages and the foundation of their homes.  The residents have made arrangements to meet with the contractor from the apartments and would like a representative from the Village to attend this meeting. As Superintendent Kilburn is out of town, Mayor Doster will contact Highway Foreman Don Norton to attend this meeting and report back to him.  They also requested that the original site plan be reviewed to see how the issue of water run off was to be handled and if they did everything they were supposed to do.

One family also complained about Emkay Trading regarding the dust, noise, and the lack of a buffer zone on the northwest part of the property. They wanted to know why nothing was being done about these issues and why an e-mail was not answered.  Mayor Doster stated that he would look into the allegations and get back to them, as he had never received the e-mail.

GRANTS FOR THE ARCADE AND ATTICA RAILROAD

Councilperson Kathryn Landahl representing Town Supervisor Doug Berwanger informed the board that the A&A Railroad is eligible for two grants. One grant is to rebuild the tracks and the other is for the restoration of the steam engine. The second grant for the steam engine requires that a municipality sponsor it.  Supervisor Berwanger would like the Village to finance 25% of the cost of the grant writer with the town financing 25% and the county 50%. The board was very enthusiastic about the concept but was the matter was table until they knew the cost to the Village. 

SIDEING ON NEW FIRE HALL

Superintendent Kilburn recommends that this be tabled until more information is received from Just Barns.

LEASE AGREEMENT – YOUTH TOGETHER ORGANIZATION

Attorney Robert Kutzuba and Superintendent Kilburn are currently working together to develop a Lease Agreement for the upstairs of the Old Fire Hall to the Youth Together Organization for a Community Center.  This should be ready for review at the next meeting.

Motion by Trustee Kosmerl, seconded by Trustee Burkett and unanimously carried that the following budget adjustments be approved as requested by the Clerk-Treasurer:

AUDIT BILLS

Motion by Mayor Doster, seconded by Deputy Mayor Ely and unanimously carried the Village bills be audited and paid and that the clerk be granted permission to transfer funds from the money market accounts to the checking accounts to cover such bills.

OCTOBERFEST – OCTOBER 9, 2004

Motion by Trustee Burkett, seconded by Mayor Doster and unanimously carried Sanford Avenue be closed off between the hours of 9:00 a.m. and 6:00 p.m. for an Octoberfest sponsored by the Arcade Merchants Committee.

HOCKEY RINK IN PARK

By order of the Village Board the hockey rink in the park is closed to the public until such time it can be repaired and put back into a safe condition. Chief Laird was ordered to put tape and signs on the facility.

Motion by Deputy Mayor Ely, seconded by Trustee Kosmerl and unanimously carried the resignation of Michael Dodge from the Arcade Planning Board be accepted with regret.
