At a regular meeting of the Board of Trustees of the Village of Arcade, Wyoming County, New York held on Tuesday, October 5, 2004, at 7:00 P.M. there were:

NOTICE
Pursuant to Article 7 of the Public Officers Law, notice of this meeting was given to the media on the 24th day of September, 2004 and the same posted on the 24th day of September, 2004.
PLEDGE TO ALLEGIANCE
Mayor Doster opened the meeting with the Pledge to Allegiance.
APPROVE MINUTES
Motion was made by Trustee Burkett, seconded by Deputy Mayor Ely and unanimously carried that the minutes from a regular board meeting held on September 21, 2004 as presented.
NORTH STREET WATER PROBLEM
Foreman Donald Norton gave a report on what took place at the meeting with the residents of North Street and the Engineer from the Douglas Drive Apartments he was asked to attend in Superintendent Kilburn’s absence. It appears that there is a pile of dirt left over from the construction of the apartments that could be diverting some water onto the homeowner’s property on North Street. They will eliminate the dirt pile, relandscape, put in another culvert and clean the original swale of all debris. They felt that this should take care of 90% of the problem. The Engineers did not feel that they are responsible for the damage to the garages as that type of damage happens very gradually over the course of several years and the fact that there are no gutters on the garage and water comes down and sits by the foundation every season.
AWARD BID – BELT FILTER PRESS
Motion by Mayor Doster, seconded by Trustee Burkett and unanimously carried the bid for a belt filter press and equipment be awarded to Koester Associates of Canastota, New York in the amount of $135,000 upon recommendation of Superintendent of Public Works Larry Kilburn.
SIDING ON FIRE HALL
Motion by Trustee Reisdorf, seconded by Mayor Doster and unanimously carried the bid for siding on the Fire Hall be awarded to Just Barns of Java, New York in the amount of $31,500 upon recommendation of Superintendent of Public Works Larry Kilburn contingent upon repairs to the down spouts and the support of Chief Williams to move funds from the departments equipment account to cover the balance.
AMENDMENT – SUBDIVISION REGULATIONS
The board reviewed the proposed wording amendment to the Subdivision Regulations regarding sidewalks. Motion by Mayor Doster, seconded by Trustee Reisdorf and unanimously carried the following proposed amendment will be sent to the Planning Board for their review and comments:
Sidewalks – the Developer shall design and construct 6-foot wide concrete sidewalks (designed in accordance with Chapter 55 of the Village Code). The sidewalk shall parallel the traveled portion of the street and be located so that the inside edge of the walk is one (1) foot inside the edge of the right-of-way unless approved otherwise by the Village Department of Public Works.
AMENDMENT – WATER RULES AND REGULATIONS
This item was tabled until a full board is present.
ALLOCATION OF PILOT AGREEMENT – NORTHRIDGE HOMES

LEASE AGREEMENT – YOUTH TOGETHER ORGANIZATION
The Board reviewed a proposed Lease Agreement between the Village of Arcade and the Youth Together Organization for the upstairs of the old Fire Hall and had one change to be made. Motion was made by Trustee Burkett, seconded by Mayor Doster and unanimously carried Mayor Doster be empowered to execute said Lease Agreement with the amended wording on paragraph 15.
IEEP PROGRAM – COMPACT FLORESCENT LAMPS
Motion by Trustee Burkett, seconded by Deputy Mayor Ely and unanimously carried the Village of Arcade Electric System participate in the Energy Star Labeled Compact Fluorescent Light Bulb Program and the Energy Star Appliance Program offered through the Independent Energy Efficiency Program. Through the Compact Fluorescent Light Bulb Program all residential customers will receive a coupon entitling them to receive two energy efficient bulbs from local merchants. The Appliance Program will encourage residential customers to upgrade their appliance to Energy Star labeled appliance with a rebate program.
REVIEW PERFORMANCE REVIEW FORM
The board reviewed a format for a performance review of salaried employees. Several changes were suggested and will be incorporated into the form for review at the next meeting.
TOWN OF ARCADE AND TOWN OF FREEDOM FIRE CONTRACTS
Motion by Trustee Burkett, seconded by Trustee Reisdorf and unanimously carried the Fire Contracts for the Town of Arcade and the Town of Freedom be amended to reflect the additional insurance policy for this year for the ambulance personnel. A special meeting will be held to finalize the numbers.
PERMISSION TO ATTEND WORKSHOPS
Motion by Mayor Doster, seconded by Deputy Mayor Ely and unanimously carried permission be granted to the Mayor, Board, and any Administrative personnel to attend a NYCOM Economic Development Regional Workshop in East Aurora on October 26, 2004.
Motion by Mayor Doster, seconded by Trustee Burkett and unanimously carried permission be granted to Superintendent Kilburn to attend the Office of the State Comptroller’s October 14, 2004 teleconference, “Cheaper by the Dozen: Procurement Cost Saving Tips for Local Governments’” in Warsaw, New York.
PERMISSION TO EXTEND RESIDENCY REQUIREMENT
Motion by Deputy Mayor Ely and seconded by Trustee Burkett Lineman Greg Johnson be granted a six-month extension on his residency requirement. Greg is continuing his efforts to sell his home in Wellsville. The motion was approved upon the following vote:

BUDGET ADJUSTMENTS
Motion by Trustee Reisdorf, seconded by Mayor Doster and unanimously carried that the following budget adjustments be approved as requested by the Clerk-Treasurer:

AUDIT BILLS
Motion by Mayor Doster, seconded by Trustee Burkett and unanimously carried the Village bills be audited and paid and that the clerk be granted permission to transfer funds from the money market accounts to the checking accounts to cover such bills.
HOCKEY RINK
Motion by Mayor Doster, seconded by Trustee Reisdorf and unanimously carried the hockey rink in the park is officially opened to the public contingent upon the outside of the rink being painted. There is a possibility that Pepsi will be putting up a score board at the rink in the near future.
DONATION TO THE DOG HOLDING CENTER
Chief John Laird representing the Fabulous 50’s Committee presented a check in the amount of $1,230.00 to Cheryl Parker for the Dog Holding Center.
SEQR – NORTH STREET WATER DISTRIBUTION MAIN REPLACEMENT
The following resolution was offered by Trustee Burkett and seconded by Mayor Doster:
RESOLUTION
WHEREAS, the village is preparing to undertake the construction activities necessary for the replacement of the North Street water line, and
WHEREAS, the village must evaluate the project for its potential impact on the environment according to 6 NYCRR Part 617 of the State Environmental Quality Review (SEQR), and
WHEREAS, in Part 617.5, Type 2 Actions are specifically enumerated, and in paragraph 617.5(c)2 the replacement of a facility in kind on the same site is listed as a Type 2 Action and does not significantly impact the environment and is not subject to review,
NOW, THEREFORE, Be It Resolved, that the Village Board find that the North Street Water Distribution Main Replacement project is a Type 2 Action and they further determine that no further review under Part 617 needs to be completed for the project.

TRANSMISSION LINE STRUCTURE REPAIR
There is a possibility of a system wide shutdown of Arcade Electric on Sunday, October 24, 2004 to repair a transmission line pole. The power could be off for up to 8 hours.
