At a regular meeting of the Board of Trustees of the Village of Arcade, Wyoming County, New York held on Tuesday, November 2, 2004, beginning at 7:00 P.M. there were:

NOTICE

Pursuant to Article 7 of the Public Officers Law, notice of this meeting was given to the media on the 21st day of October, 2004 and the same posted on the 21st day of October, 2004.

PLEDGE TO ALLEGIANCE

Mayor Doster opened the meeting with the Pledge to Allegiance.

APPROVE MINUTES

Motion by Trustee Burkett, seconded by Trustee Kosmerl and unanimously carried the minutes from a regular meeting held on October 19, 2004 be approved as presented.

IEEP PRESENTATION

Mike Lyons from Honeywell the Program Manager for the IEEP (Independent Energy Efficiency Program) addressed the board regarding two new programs the Village of Arcade will be offering to all residential electric customers.  He explained that the Village has been involved in the program for the past ten years and in that time 140 commercial lighting audits were done with 80 lighting upgrade projects completed. There were 4 large industrial electric motors replaced with energy efficient models in the industrial sector and variable speed drives installed at Blue Seal.  High efficient decorative lighting was installed at the Village Park, 8 public emergency backup generators were installed, and new AMR meters were installed to allow the Village to serve their customer better and more cost effectively.  The new programs include Energy Star to create awareness for energy efficient products allowing consumers to save money while protecting the environment. Energy Star appliances are 20-40% more efficient than standard products, utilizing sate of the art technology.  The program will allow customers to receive a rebate on the purchase of any Energy Star appliance.  The second program is for Compact Fluorescent Light Bulbs.  Each customer in the Arcade Electric System will receive a coupon for two free compact fluorescent light bulbs. They will be available at Logel Appliance, C&G Electric and Tractor Supply. Mr. Lyons presented each board member with a light bulb to kick off the program.  The board members turned the bulbs over to the Village Office for their use.

SET PUBLIC HEARING FOR AMENDMENT TO SUBDIVISION REGULATIONS

Superintendent Kilburn presented the board with information regarding the requirement of a bond being held until a subdivision project is completed and accepted by the Village.  Due to the length of the addition to the Subdivision Regulations and because there is cost implications for the developer the board will review the information and table any action until the next board meeting.

PERFORMANCE REVIEW FORMS – SALARIED EMPLOYEES

Suggestions from the last board meeting have been incorporated into the form and will be reviewed by the board. This matter will be discussed at the next board meeting when a full board is present.

REPRESENTATIVE TO WYOMING COUNTY YOUTH BOARD

The board will continue to look for someone to fill this position representing the Village and Town of Arcade on the Wyoming County Youth Board.

TOWN ASSESSOR REQUEST FOR ADDITIONAL SPACE

Town Assessor Dave Smith has requested more room at the old Firehall.  He would like the Village to partition off the end of the truck bay closest to the Town Office so they can place their file cabinets and maps in that area. After discussion a motion was made by Mayor Doster, seconded by Trustee Kosmerl and unanimously carried the request be denied as the Village also has an issue with storage area.

APPOINTMENT TO ARCADE RECREATION COMMISSION

Motion by Trustee Burkett, seconded by Deputy Mayor Ely and unanimously carried Vicky Maher be appointed to the Arcade Recreation Commission upon recommendation of Barbara Wagner.

SUGGESTED LIMITATIONS TO GRADL VARIANCE TO BE SENT TO ZONING BOARD OF APPEALS

Gary and Cynthia Gradl have made application to the Zoning Board of Appeals for a use variance to use the 5 bay garage with gravel drive and lot for sales, installation, service, storage, repair of snow removal and landscape equipment vehicles and parts and for storage of vehicles.  The two bay garage/barn will be used for storage only.  The board discussed if they should make any recommendations to the Zoning Board regarding restrictions and felt that it was not their job to micromanage the Zoning Board. If anyone has suggestions they should attend the Public Hearing to be held by the Zoning Board. 

LEGISLATIVE INITIATIVE GRANT – POLICE RADIOS

Chief Laird reported that Senator Dale Volker has awarded the Police Department a Legislative Initiative grant in the amount of $7,000 for the updating of the radio system in the three patrol cars. The radios will be needed as soon as Wyoming County gets their new tower and equipment up and running.

LIGHTING AT TOPS SERVICE STATION

The lighting installed at the new gas station at Tops does not meet our new Lighting Regulations nor does it meet the description provided in the Phillips Lytle package dated June 30, 2004 that was presented to the board.  Superintendent Kilburn and Zoning Officer Zielonka met with Tops regarding this matter and several options were discussed. Chuck Morris was present to inform the board of the changes that will be made to the lighting within the next two weeks to bring the station into compliance.

BUDGET ADJUSTMENTS

Motion by Trustee Burkett, seconded by Trustee Kosmerl and unanimously carried the following budget adjustment be approved as presented by the Clerk:

AUDIT BILLS

Motion by Mayor Doster, seconded by Trustee Burkett and unanimously carried the Village bills be audited and paid and that the clerk be granted permission to transfer funds from the money market accounts to the checking accounts to cover such bills.

HALLOWEEN UPDATE

Chief Laird informed the board that Halloween went normally with one broken window at the Methodist Church.

GLEN COOPER LETTER

Motion by Mayor Doster, seconded by Trustee Kosmerl and unanimously carried Glen Coopers request for reimbursement for erosion to his property be turned over to Arcade-Knight Agency for their review.

RETIREMENT DATE

Clerk Offers informed that board that she will be retiring as of September 13, 2005 after 27 years with the Village.  The board will establish a committee to find a replacement.1

EXECUTIVE SESSION

Motion by Trustee Burkett, seconded by Deputy Mayor Ely and unanimously carried the board enter executive session to discuss a personnel matter with possible disciplinary action.

Motion by Trustee Burkett, seconded by Mayor Doster unanimously carried to board exit executive session.

REPORTS RECEIVED

Village Justice and Acting Village Justice reports for the month of October were received, reviewed and placed on file.

Ambulance report for the month of October was received, reviewed and placed on file.

Fire report for the month of October was received, reviewed and placed on file
