The regular meeting of the Board of Trustees of the Village of Arcade, Wyoming County, New York was held on Tuesday, May 3, 2005 at 7:00pm there were:

PRESENT

Mayor Michael Doster, Deputy Mayor Richard Kosmerl, Trustee Paul Burkett, Trustee Hugh Ely, Trustee Daniel Reisdorf, Superintendent of Public Works Larry Kilburn, and Clerk/Treasurer Joanne Offers

ALSO PRESENT

Police Chief John Laird, Deputy Village Clerk Temporary Pam Beiersdorf, Deborah Titus (Arcade Herald), Karen Norton, and Daniel Meyers

NOTICE

Pursuant to Article 7 of the Public Officers Law, notice of this meeting was given to the media on the 25th day of April 2005 and the same posted on the 25th day of April 2005.

PLEDGE TO ALLEGIANCE

Mayor Doster opened the meeting with the Pledge to Allegiance.

EXECUTIVE SESSION

Motion by Trustee Burkett, seconded by Trustee Ely, and unanimously carried the Board enter executive session to discuss possible misconduct of a specific employee.

Motion by Trustee Reisdorf, seconded by Mayor Doster, and unanimously carried permission be granted to exit executive session.

APPROVE MINUTES

Motion by Trustee Ely and seconded by Deputy Mayor Kosmerl the minutes from the annual and regular meeting held on April 19, 2005 be approved as presented.  The motion was approved upon the following vote:

VILLAGE PARK CONCERNS

Karen Norton, Village resident, asked permission from the Board to purchase approximately 150 ft. of landscape edging to place around gardens at the memorial and village parks. Clerk Offers will check to see if there are available funds in the 2004-05 budget.  If not, it was suggested that possibly the Beautification Committee would be able to finance this request.

Mrs. Norton reminded the Board that last spring they had approved Domes Tree Farm to trim 19 pine tress along the Village Park. Numerous attempts have been made to contact Domes Tree Farm, however, no actions have been taken to trim the trees.  The Board approved Superintendent of Public Works Kilburn to research and contact other tree trimming contractors.

Lastly, Mrs. Norton reminded the Board and encouraged their participation at the upcoming "Cleanup Around Arcade Day" scheduled for Saturday, May 7, 2005. Interested parties are asked to meet at the Arcade Firehall, Route 98 at 8:30am.

ARCADE PLANNING BOARD APPOINTMENT

Motion by Trustee Burkett, seconded by Mayor Doster, and unanimously carried Mr. Daniel Meyers be appointed to the Arcade Planning Board.

PERMISSION TO ATTEND SEMINAR

Motion by Trustee Burkett, seconded by Mayor Doster, and unanimously carried permission be granted to Deputy Clerk Janet Payne, to attend a seminar on Fair Labor Standards Act Wage and Hour Law Compliance on June 6, 2005 at the Hyatt Regency, Buffalo, NY. The agenda consists of understanding the exemption classifications, timekeeping and recordkeeping requirements and methods, and calculations for comp time, overtime, on-call time, travel time.

NYCOM 2005 ANNUAL MEETING

Board members were reminded about the upcoming New York Conference of Mayor's annual meeting scheduled for June 12-15, 2005 in Saratoga Springs, NY. Pre-Registration is required by May 20, 2005. Tentative topics for this years meeting include: local legislation and meeting procedures, responsibilities and liabilities of public officials, basics of municipal finance, traffic and parking regulations, administration of volunteer fire departments, state and federal laws affecting municipal employers, intermunicipal agreements, economic development, grants, stress management, etc.

PERMISSION TO ATTEND SEMINAR

Motion by Trustee Burkett, seconded by Mayor Doster, and unanimously carried permission be granted to Deputy Clerks Payne and Beiersdorf, to attend a seminar presented by the Wyoming County Job Service Employers Committee (JSEC) and the Wyoming County Chamber of Commerce on Recordkeeping – What you need to know! on Wednesday, May 4, 2005 at the Byrncliff Conference Center in Varysburg, NY.  The agenda consists of issues relating to identity theft, HIPPA, and disposition of interview records.

BUDGET ADJUSTMENTS

Motion Deputy Mayor Kosmerl, seconded Trustee Burkett, and unanimously carried the following budget adjustment be approved as presented by the Clerk.

AUDIT BILLS

Motion by Mayor Doster, seconded by Trustee Reisdorf, and unanimously carried the Village bills be audited and paid and that the Clerk be granted permission to transfer funds from the money market accounts to the checking accounts to cover such bills.

PARTNERS FOR PREVENTION REQUESTS PERMISSION TO HANG BANNER

Motion by Trustee Ely, seconded by Deputy Mayor Kosmerl, and unanimously carried Partners for Prevention be granted permission to hang their campaign logo and slogan banner entitled, "Parents Who Host Lose The Most" on the Municipal Building. Partners for Prevention is a coalition of Wyoming County agencies that encourages focus on substance abuse prevention and implementation of strategies targeting underage drinking and marijuana use by youth.

PERMISSION TO ADVERTISE BID

Motion by Mayor Doster, seconded by Deputy Mayor Kosmerl, and unanimously carried Superintendent of Public Works Kilburn be granted permission to prepare bid package and advertise said bid for the purchase of a new Water Department dump truck.  Bid(s) will be opened at the regular meeting scheduled for June 7, 2005.

PIONEER HIGH SCHOOL AGRICULTURE DEPARTMENT REQUEST

Motion by Trustee Reisdorf, seconded by Mayor Doster, and unanimously carried the Environmental Science Class of Pioneer High School be granted permission to repair, revitalize, and rejuvenate a nature trail at the Arcade Village Park as outlined by Superintendent of Public Works Kilburn.

SEASONAL CUSTOMERS

After continued discussion on this topic, the Board seeks additional clarification.  They requested that "seasonal customer" be defined and a duration determined. Once this information is obtained and scenarios calculated the Board would move forward in finalizing this matter.

PERMISSION TO ATTEND ARCADE AREA CHAMBER OF COMMERCE ANNUAL DINNER

Motion by Mayor Doster, seconded by Trustee Reisdorf, and unanimously carried permission be granted to the Mayor, Board of Trustees, Superintendent of Public Works, Clerk/Treasurer, to attend the Arcade Area Chamber of Commerce Annual Dinner on Saturday, May 14, 2005 at 6:00pm at the Holland Willows.

NORTHRIDGE HOMES

Mayor Doster distributed a brochure to the Board that outlines the requirements, programs, and services provided at Northridge Homes. Applications are now available by calling (585) 237-2600 or (585) 237-6333 or may be picked up at Community Action for Wyoming County in Perry, NY.

PROCLAMATION FOR MR. MERV PALMERTON

Motion by Mayor Doster, seconded by Trustee Burkett, and unanimously carried the Board approves the proclamation for Mr. Merv Palmerton as follows:

    WHEREAS, Mayor Michael Doster and the Arcade Village Board of Trustees wish to announce May 14, 2005 be declared  Merv Palmerton Day in the Village of Arcade.

    WHEREAS, volunteer Merv Palmerton, a 50 year member of the Arcade Volunteer Fire Department, started his career in October 1954. As a father of three sons, Merv found time to hold two jobs and volunteer his time with the fire department as well as serve on numerous committees. In 1959, Merv was elected Fire Chief and continued in that position until 1963.  Merv is a life member of the Wyoming County Association of Fire Chiefs and the Firemen's Association of the State of New York.  Merv remains an active member of the fire department and attends regular meetings and functions.

    THEREFORE, in recognition of Merv's 50 years of service to the residents of the Village of Arcade and the surrounding areas, we congratulate Merv on his dedication and commitment and wish him continued involvement in the fire department.  Thank you, Merv!

Also, carried by the preceding motion, permission has been granted to publish the above proclamation in the Arcade Herald the week of April 9, 2005.
