A regular meeting of the Board of Trustees of the Village of Arcade, Wyoming County, New York held on Tuesday, March 1, 2005 at 7:00pm there were:

Mayor Michael Doster, Deputy Mayor Hugh Ely, Trustee Paul Burkett, Trustee Daniel Reisdorf, Superintendent Larry Kilburn, Clerk/Treasurer Joanne Offers

ABSENT

Trustee Richard Kosmerl

ALSO PRESENT

Police Chief John Laird, Deborah Titus – Arcade Herald (7:25pm), Deputy Village Clerk Temporary Pam Beiersdorf, BJ Moore, Dan Laird (7:21pm), April Lincoln (student), Erin Brauen (student)

NOTICE

Pursuant to Article 7 of the Public Officers Law, notice of this meeting was given to the media on the 17th day of February, 2005, published on the 24th day of February 2005, and the same posted on the 24th day of February, 2005.

PLEDGE TO ALLEGIANCE

Mayor Doster opened the meeting with the Pledge to Allegiance.

APPROVE MINUTES

Motion by Trustee Burkett and seconded by Trustee Reisdorf the minutes from a regular meeting held on February 15, 2005 and from a special meeting held on February 25, 2005 be approved as presented. The motion was approved upon the following vote:

PERMISSION TO DESTROY RECORDS

Motion by Mayor Doster, seconded by Trustee Reisdorf , and unanimously carried the following records be destroyed in accordance with the Village’s Retention Policy:

 Purchase Orders for 1998-1999
 Purchase Orders for 1999-2000

FINAL RAILROAD CEILING

Clerk Offers informed the board that the 2005 Certificate of Final Railroad Ceiling was received from the New York State Board of Real Property Services and the amount remains the same as the tentative.

ELECTRIC REVENUE ANTICIPATION NOTE (RAN) AWARDED

Clerk Offers informed the board that the Electric RAN was awarded to First Niagara Bank at 2.61% on the 24th day of February 2005 for the RAN renewal on the 11th day of March.

WASTE WATER TREATMENT PLANT POSITION

As recommended by Superintendent of Public Works, Larry Kilburn, a motion was made by Trustee Burkett, seconded by Trustee Reisdorf, and unanimously carried to hire Patrick Weaver, a Village Resident, as Waste Water Treatment Plant Trainee effective 04/15/05 to 06/01/05 at a salary of $12.67.  The effective date is based on need and is at the discretion of the Superintendent of Public Works.

BUDGET ADJUSTMENTS

Motion by Trustee Burkett, seconded by Mayor Doster, and unanimously carried the following budget adjustment be approved as presented by the Clerk:           Available upon Request

AUDIT BILLS

Motion by Trustee Reisdorf, seconded by Trustee Burkett, and unanimously carried the Village bills be audited and paid and that the Clerk be granted permission to transfer funds from the money market accounts to the checking accounts to cover such bills.

REPORTS RECEIVED

Fire reports for the month of February were received, reviewed and placed on file.
Ambulance report for the month of February was received, reviewed and placed on file.

PERMISSION - BOCES STUDENT INTERNSHIP

As presented by Police Chief John Laird, motion by Mayor Doster, seconded by Trustee Burkett, and unanimously carried that Amanda Carmichael, a BOCES student, be granted permission to perform an internship with the Village of Arcade Police Department subsequent to the Village receiving a copy of BOCES' insurance.  The internship will be effective for a two week period (March 7th through March 18th, 2005), three days per week, at two hour intervals.

LIGHTING COMPLIANCE FAILURE

Due to lack of compliance, the Board has directed the Zoning Officer to send correspondence to Tops Markets notifying them to cease and desist operations of their gas facility until the previously discussed lighting issue is resolved according to regulation.

EXECUTIVE SESSION

Motion by Mayor Doster, seconded by Trustee Burkett, and unanimously carried the board enter executive session to discuss personnel issue with potential disciplinary action.

Motion by Trustee Reisdorf, seconded by Mayor Doster, and unanimously carried the board exit executive session.

SEWER BUDGET

The remainder of the meeting was spent reviewing the Sewer budget for 2005-2006.

There being no further business to come before the board the meeting was adjourned at 9:00pm upon motion by Trustee Burkett and seconded by Mayor Doster.
