At a regular meeting of the Board of Trustees of the Village of Arcade, Wyoming County, New York held on Tuesday, June 1, 2004, at 7:00 P.M. there were:

NOTICE

Pursuant to Article 7 of the Public Officers Law, notice of this meeting was given to the media on the 19th day of May 2004 and the same posted on the 19th day of May 2004.

PLEDGE TO ALLEGIANCE

Mayor Doster opened the meeting with the Pledge to Allegiance.

APPROVE MINUTES

Motion by Trustee Reisdorf, seconded by Trustee Burkett and unanimously carried the minutes from a regular board meeting held on May 18, 2004 be approved as presented.

Motion by Trustee Reisdorf and seconded by Trustee Burkett the minutes form a special meeting held on May 28, 2004 be approved as presented upon the following vote:

KAREN NORTON – TREES IN THE PARK

Karen Norton addressed the board regarding the removal of trees from the Village Park and the replacement policy. She realizes that many of the trees are very old and in bad condition and her concern is that eventually there will be a park with no trees in it.  She was informed that the Village does have a fairly recent tree replacement policy to replace every tree that they remove.  The four trees in front of the park cabin should be removed as they are too close to the building and do not allow light into the building. They should be replaced with decorative plantings.

PETITION – ODOR AT EMKAY TRADING

The Village has received a Petition from the residents on West Street, West Main Street and North Street regarding a Violation of Section 806 of the Zoning Ordinance that states there shall be no emission of odorous gases or other odorous matter in such quantities as to be offensive on adjoining streets or adjacent lots.  The petition, which is attached, has 76 signatures. This petition has been turned over to the attorney.

CONCERNED HASKELL AVENUE RESIDENTS

A Petition from The Concerned Citizens on Haskell Avenue signed by 50 people was received by the Village.  It read “We, the residents of Haskell Avenue, understand that our street is scheduled for some paving work this year.  We feel that the planned reconstruction is inadequate for the conditions.  We respectfully request that storm drains be installed, where needed, to take care of excess water.  Also that the road be dug down and paved to prevent further run-off of water. If the budget will not stand these improvement this year, we would ask that storm drains be installed this year and pavement scheduled for 2005.

Trustee Reisdorf had a picture presentation for the board showing drainage problems on the street.  They would like to see all water drainage problems fixed before the road is resurfaced. The Village will investigate and find out what can be done and report back at the next meeting with ideas.

207C CLARIFICATION

In reviewing the records it was found that when John Rix was on 207C benefits were accrued. NYCOM has told Chief Laird that while on 207C normally any benefits earned are frozen and no new benefits are accrued. Chief Laird will review and turn the information over to the attorney.

REVIEW BULLETIN BOARD

Items on the Bulletin Board were reviewed. Several items were discussed and some added for future review.

BUDGET ADJUSTMENTS

Motion by Trustee Burkett, seconded by Mayor Doster and unanimously carried the following budget adjustment be approved as presented by the Clerk:

BID OPENING – FOUR WHEEL DRIVE TRACTOR

This meeting having been duly advertised for the receival of bids for a four wheel drive tractor plus attachments the above mentioned people were in attendance.  The following bids were received.

Motion by Trustee Reisdorf, seconded by Mayor Doster and unanimously carried the tractor plus attachments be rebid.

BID OPENING – COMPREHENSIVE PLAN UPDATE

This meeting having been duly advertised for the receival of bids for a Comprehensive Plan Update the above mentioned people were in attendance.  The following bids were received:

Motion by Trustee Kosmerl, seconded by Trustee Reisdorf and unanimously carried the bids be turned over to Superintendent Larry Kilburn for his review and recommendation.

AUDIT BILLS

Motion by Mayor Doster, seconded by Trustee Kosmerl and unanimously carried the Village bills be audited and paid and that the clerk be granted permission to transfer funds from the money market accounts to the checking accounts to cover such bills.

RESIGNATION

Motion by Mayor Doster, seconded by Trustee Kosmerl and unanimously carried the resignation of Daniel S. Dytchkowskjy from the Arcade Police Department effective June 1, 2004 be accepted with regret.

Motion by Trustee Kosmerl, seconded by Mayor Doster and unanimously carried permission be granted to Chief Laird to fill the part-time officer position vacated by Mr. Dytchkowskjy.

LIABILITY INSURANCE

Motion by Mayor Doster, seconded by Trustee Burkett and unanimously carried the insurance for the Village be renewed with Arcade Knight Agency with Option #2 and that tail coverage be added.

SWEEPER BID

Motion by Mayor Doster, seconded by Trustee Reisdorf and unanimously carried permission be granted to Superintendent Kilburn to bid for the purchase of a used sweeper not to exceed $65,000.

REPORTS RECEIVED

Ambulance Report for the month of May was received, reviewed and placed on file.
