At a regular annual meeting of the Board of Trustees of the Village of Arcade, Wyoming County, New York held on Tuesday, June 15, 2004, at 7:00 P.M. there were:

NOTICE

Pursuant to Article 7 of the Public Officers Law, notice of this meeting was given to the media on the 4th day of June, 2004 and the same posted on the 9th day of June, 2004.

Mayor Doster opened the meeting with the Pledge to Allegiance.

APPROVE MINUTES

Motion by Trustee Burkett and seconded by Trustee Kosmerl the minutes from a regular board meeting held on June 1, 2004 be approved as presented.  The motion was approved upon the following vote:

CONCERNED BUSINESS MEN

Phil Antonio addressed the board reaffirming that the purpose of this group of concerned businessmen is to improve the conditions in our community and not to show discontent with leadership or the Village and Town boards. They would like to see forward thinking leadership through an advisory partnership consisting of business, industry, lenders, government and residents to provide a vision and guidance to the area for the future. They feel the Village and Town boards should be working for the greatest good of the people to make Arcade first and prosperous again.  Another goal of the committee is to promote and retain the businesses we have.

Doug Berwagner, Town Supervisor and Chairman of the Board for Wyoming County also addressed those present regarding economic development issues for the area. He feels that zoning can be an impediment to economic development not only in Arcade but also throughout the county. He feels that zoning is too restrictive and needs to be user friendly for recruitment of businesses.  He also discussed the IDA, Empire Zones, agricultural land use, and land use in general. The county recognizes that it needs direction in these areas and has established a task force of members from the County, the IDA and the Wyoming County Chamber of Commerce to address these issues.  Mr. Berwanger also stated that Arcade is the commerce capital of the County.

The board has requested that the group return to the July 20th meeting with their Mission Statement and goals for the committee.

ADOPT LOCAL LAW 2-2004 – ZONING MAP

The following resolution was offered by Trustee Kosmerl and seconded by Mayor Doster:

RESOLUTION

WHEREAS, a proposed Local Law to add Chapter 63G Zoning Map – Northridge Homes to the Zoning Laws of the Village of Arcade was presented to the board at a regular meeting held on the 20th day of April, 2004, and

WHEREAS, the Village Clerk has certified that the Open Meetings Law has been complied with in regards to the calling of a meeting of the Board of Trustees which was held on the 20th day of April, 2004, and at such meeting a Resolution was adopted to schedule a public hearing on said proposed Local Law on the 18th day of May, 2004, and

WHEREAS, the Wyoming County Planning Board met on the 3rd day of May, 2004 and voiced no objection to the amendment, and

WHEREAS, the Village Planning Board met on the 9th day of May, 2004 and voted to recommend the change to the Zoning Map, and

WHEREAS, a final copy of the proposed Local Law No. 2-2004 was placed on the desk of each Board member by the Village Clerk on the 20th day of April, 2004, and

WHEREAS, the Notice of said public hearing was published in the Arcade Herald on the 6th day of May, 2004, and

WHEREAS, the Village Clerk has certified that the Open Meetings Law has been complied with in regards to the Public Hearing called on the 18th day of May, 2004, and this Board having met on that day and conducted said public hearing and considered such arguments as were presented for and against the adoption of Proposed Local Law No. 2-2004, and

WHEREAS, the Village Clerk has certified that the Open Meeting Law has been complied with in regard to this meeting;

NOW, THEREFORE, Be It Resolved, as follows:

THAT Proposed Local Law No. 2-2004 of the Village of Arcade as presented at the public hearing be and the same be enacted to read as follows:

CHAPTER 63G

ZONING MAP – NORTHRIDGE HOMES

 A Local Law to amend the zoning map of the Village of Arcade to rezone lands the following properties:

Lands on the North side of North Street currently owned by Michael Tingue (TIN 183.009-1-1.1) from R1 Low Density Residential (No Public Sewers) to R3 Medium Density Residential.

 Be it enacted by the Board of Trustees of the Village of Arcade, that the zoning map of the Village of Arcade is hereby amended to reflect the above change.

The aforesaid resolution was adopted upon the following vote:

AWARD BID – COMPREHENSIVE PLAN UPDATE

Motion by Trustee Kosmerl, seconded by Mayor Doster and unanimously carried the bid for the Comprehensive Plan Update be awarded to the Genesee Finger Lakes Regional Planning Board from Rochester, New York in the amount of $25,000 upon recommendation of Superintendent Larry Kilburn.  The biggest component of the update is for downtown revitalization.

AMENDMENT TO EMERGENCY DISASTER PLAN

Motion by Trustee Burkett, seconded by Trustee Reisdorf and unanimously carried the Emergency Disaster Plan Appendix G be updated as follows:

REVIEW OF FINANCIAL CASH REPORT

Clerk Offers presented the board with the Annual Financial Cash Report for the year ending May 31, 2004 for their review. (Copy of said report is on file in the clerk’s office.)

PERFORMANCE EVALUATIONS

Members of the board submitted several types of performance evaluations for review by the salaried employees so that a form for the Village can be established. The salaried employees will meet and report back to the board at the July 20th meeting.

PERMISSION TO BUY TRACTOR ON STATE CONTRACT

Motion by Trustee Burkett, seconded by Trustee Kosmerl and unanimously carried permission is granted to Superintendent Kilburn to purchase a tractor for the Water Department on State Contract at a price of $23,640.

HASKELL AVENUE UPDATE

Residents from Haskell Avenue were present to see what was going to be done on their street this year regarding drainage. Superintendent Kilburn informed them that they had looked at the situation but currently have no answers. They were assured that the street would not be milled until the drainage issue is taken care of.

BUDGET ADJUSTMENTS

Motion by Trustee Kosmerl, seconded by Trustee Burkett and unanimously carried the following budget adjustments be approved as presented by the Clerk:

AUDIT BILLS

Motion by Mayor Doster, seconded by Trustee Kosmerl and unanimously carried the Village bills be audited and paid and that the clerk be granted permission to transfer funds from the money market accounts to the checking accounts to cover such bills.

AWARD MISCELLANEOUS ELECTRIC BIDS

Motion by Trustee Burkett, seconded by Mayor Doster and unanimously carried the bids for miscellaneous electric items be awarded to the lowest responsible bidder based on the recommendation of Superintendent Larry Kilburn. A full list of the bids awarded is attached to these minutes.

PARK GRANT

After review the village will not be applying for a park grant this year as we were not able to negotiate the purchase of property needed for the grant.

REPORTS RECEIVED

Receipts and Disbursements report for the month of May was received, reviewed and placed on file.

Village Justice and Acting Village Justice reports for the month of May were received, reviewed and placed on file.
