The regular meeting of the Board of Trustees of the Village of Arcade, Wyoming County, New York was held on Tuesday, July 5, 2005 at 7:00pm there were:

NOTICE

Pursuant to Article 7 of the Public Officers Law, notice of this meeting was given to the media on the 20th day of June 2005 and the same posted on the 20th day of June 2005.

Mayor Doster opened the meeting with the Pledge to Allegiance.

APPROVE MINUTES

Motion by Deputy Mayor Kosmerl and seconded by Trustee Burkett, the minutes from the regular meeting held on June 21, 2005 be approved with the following amendments:

       Motion by Deputy Mayor Kosmerl, seconded by Mayor Doster, and unanimously carried the following budget adjustments be approved with clarification/detail on the three discussed accounts carrying large amounts (5010 0400 0422, 0721 0007 0400, and 0792 0001).

         Village resident, Bill Connelly, commented he recognized that the Board had previously received a request to resurface the Village Park basketball court, but wanted to provide his support for this request as well.  He continued to say, that numerous kids use the court daily and two leagues are scheduled to use the court throughout the summer.

Motion by Deputy Mayor Kosmerl, seconded by Trustee Reisdorf, and unanimously carried the bids be turned over to Superintendent of Public Works Kilburn for evaluation and recommendation.

BATAVIA HOLDINGS, LLC – ZONING CONCERNS

Ms. Kim Bingman addressed the Board in regards to a recent zoning permit denial to erect a 3' x 3' sign.  Ms. Bingman asked for the Boards consideration to change or amend the existing zoning laws to allow larger signs. She was informed that the existing zoning laws were currently being reviewed and a proposed revision had been drafted.  However, until said updates have been finalized, the Board suggested Ms. Bingman proceed with the variance process.

ARCADE VILLAGE PARK HOCKEY RINK

Kris Little, League President, attended the meeting to hear the concerns of the Board regarding repairs, painting, and general housekeeping at the hockey rink.  Mr. Little stated that plans are to complete the repairs by the end of August prior to the mid-September league start. The Board requested to be advised when the repairs were finished and plan to meet at the park on 09/06/05.

PERMISSION TO PURCHASE PARK STREET PARCEL

Ownership of this parcel is unclear. The Board requested clarification of the ownership prior to proceeding with this matter.  Superintendent of Public Works Kilburn is pursuing ownership with the Village attorney. If it is determined that the Village is indeed the owner of said parcel and can legally sell it, the Board requested that the owner of the Town of Arcade property located behind this parcel be contacted to ensure they have no plans to utilize said parcel as a means to access their property in the future.

PERMISSION TO ADD CHASE AS OFFICIAL DEPOSITORY

Deputy Clerk Beiersdorf requested permission to add JPMorgan Chase Bank, N.A. as an official depository of the Village of Arcade (VOA). Chase offers a high yield government savings account that could be used for temporary investments, state aid, reserve funds, capital projects, or tax collection accounts. This account offers competitive interest rates allowing funds to be liquid versus other accounts such as certificate of deposits.  The Board requested that Deputy Clerk Beiersdorf contact local banks to determine if they had comparable services. In addition, the Board asked to have definitive plans for using this depository as opposed to approving it generically for future use.

NYS ASSOCIATION OF COURT CLERKS ANNUAL CONFERENCE 2005 – UPDATE

Deputy Clerk Beiersdorf informed the Board that the NYS Association of Magistrate's Court Clerks annually awards two complete scholarship packages to attend the Annual Fall Conference of this Association.  Clerk of the Court Moore has applied for said scholarship that will cover all expenses, except for personal incidentals, at the conference. The completed application was forwarded to the Scholarship Committee for review. The Scholarship Committee forwards their recommendation to the Board of Directors to discuss at their fall meeting. The successful applicants will be notified in writing prior to the Annual Fall Conference.  The Board requested a contingency plan (due 08/02/05) be established at this time to determine funding options in case the scholarship is not awarded to us.

Motion by Deputy Mayor Kosmerl, seconded by Mayor Doster, and unanimously carried the following budget adjustments be approved as presented by the Clerk.

AUDIT BILLS

Motion by Mayor Doster, seconded by Trustee Burkett, and unanimously carried the Village bills be audited and paid and that the Clerk be granted permission to transfer funds from the money market accounts to the checking accounts to cover such bills.

ARCADE RECREATION RECEIVES DONATION

The VOA recreation program received a check in the amount of $3,244.66, which is the amount donated by Pioneer Credit Recovery, Inc. (PCR) employees during their June 2005 Charity of the Month efforts. The donations are greatly appreciated and afford the program financial assistance to provide extra opportunities to the children participating in the program.  Thank you, PCR for your support and spirit of community service.

DEPARTMENT OF TRANSPORTATION MEETING RESULTS

Superintendent of Public Works Kilburn provided the Board with the results of the meeting with NYS Department of Transportation held in the Rochester office on June 21, 2005. The meeting covered several topics including paving projects, downtown area speed study, A&A railroad crossing repairs, etc.

PERMISSION TO ATTEND TRAINING

Motion by Mayor Doster, seconded by Trustee Ely, and unanimously carried permission to attend the following training be granted and include lodging as deemed necessary:

 Sgt. Biscaro be granted permission to attend a two-day Law Enforcement Legal Issues Update Seminar on Thursday, July 21 and Friday, July 22, 2005 from 8:30am to 4:30pm at the Naval Reserve Air Station, Niagara Falls, NY. Topics include search and seizure, indelible right to counsel, confessions, vehicle stops and searches.

 Officer Spencer be granted permission to attend a two-week Basic Criminal Investigations Course from July 11 through July 22, 2005 at the Niagara Falls Air Reserve Air Station in Niagara Falls, NY.  Topics include crime scenes/physical evidence, process of investigation, interview and interrogation, DNA collection techniques, death, burglary, robbery, and missing person investigations.

Chief Laird be granted permission to attend a ½ day Sex Offender Management Training on Thursday, September 22, 2005 from 9:00am to 12:00pm in Williamsville, NY.  Topics include information regarding the Sex Offender Registration Act (SORA), law enforcement responsibilities under the Act, and a method to perform community notification.

EXECUTIVE SESSION

Motion by Deputy Mayor Kosmerl, seconded by Mayor Doster, and unanimously carried the Board enter executive session at 8:34pm to discuss possible litigation.

Motion by Deputy Mayor Kosmerl, seconded by Mayor Doster, and unanimously carried the Board exit executive session at 8:43pm.

BUSINESS ACCESSORIES

Motion by Mayor Doster, seconded by Deputy Mayor Kosmerl, and unanimously carried a letter be written to Ms. Kathleen Dear, Economic Development Loan Program (EDLP) Administrator, requesting that subsequent to receiving notice of intention to move Business Accessories, LLC out of the VOA, Mr. Manfred Koch be required to pay the balance in full on his EDLP loan.
