Pursuant to Article 7 of the Public Officers Law, notice of this meeting posted on July 12, 2006.
The work session commenced at the corner of Haskell Avenue and Deacon Drive, Arcade, NY. The purpose of the work session was to inspect the finished road surfaces of Deacon Drive (chip seal) and Haskell Avenue (slurry seal) and briefly discussed the differences. Discussed the pros and cons of alternatives to create a smoother finish on Deacon Drive. It was decided to apply fog seal, a light coat of road oil that is sprayed on the road surface. This will fill in around the stones creating a smoother surface and will help hold the stones in place.
The regular meeting of the Village of Arcade Board of Trustees, Wyoming County, New York was held on Tuesday, July 18, 2006 at 7:00pm.

STREET RESURFACING ON DEACON DRIVE
Motion by Mayor Doster and seconded by Deputy Mayor Kosmerl, the Streets & Parks Department are directed to re-fog Deacon Drive. Re-fogging should smooth out the surface and will be more aesthetically appealing.

AWARD BID - FOUR WHEEL DRIVE LOADER
Motion by Mayor Doster and seconded by Trustee Ely, upon recommendation of Streets & Parks Foreman Laird and Superintendent of Public Works Kilburn, the four wheel drive loader be awarded to Five Star Equipment of Orchard Park, NY for $81,250.00 less trade-in of $43,250.00 for a net pay of $38,000.00. George & Swede Sales & Service, Inc. of Pavilion, NY was the lowest bidder, however, didn't meet the specifications as presented in the bid package.

WATER RATE INCREASE – PENALTY
This item was tabled until the August 1, 2006 meeting as the Board requested Superintendent of Public Works Kilburn to provide an updated calculation showing penalties and minimum dollar amount as applied to the new rates, per discussion at this meeting.
DISCUSS CELLULAR TELEPHONE POLICY OPTIONS/JUSTIFICATION
Superintendent of Public Works Kilburn advised the Board that there are currently fourteen cellular telephones used in the field by Streets and Parks, Water, Sewer, and Electric department personnel. They are useful to contact coworkers in emergency outages and situations. They have proven to speed up response times and assist with resolving problems more efficiently.
Motion by Deputy Mayor Kosmerl and seconded by Mayor Doster, a cellular telephone policy shall be developed to guide employees who use VOA owned cellular telephone to conduct VOA business. Employees who are eligible for VOA owned cellular telephones shall have the same base service plan, paid by the VOA. Employees will be responsible for any overages unless the employee can prove calls were for VOA business. The cellular telephone policy will be required reading for all employees.

PERMISSION TO ATTEND TRAINING
Motion by Trustee Ely and seconded by Mayor Doster, Dan Laird be granted permission to attend training on September 12, 2006 in Batavia, NY. PRESTOLITE – FIRE WATER PROTECTION SYSTEM
Superintendent of Public Works Kilburn advised the Board that a meeting with Bill Koch to inspect the fire water protection system has been scheduled for Thursday, July 20, 2006 at 8:30am. All Board Members are encouraged to attend.
PERMISSION TO ATTEND ANNUAL COURT CLERK CONFERENCE
At the July 11, 2006 meeting, the Board reviewed the request for Gill Moore to attend the NYS Association of Magistrates Court Clerks Annual Conference. The Board asked that the Justice department research the cost of alternate travel arrangements via air. The documentation proves that it is more cost effective to drive than fly, considering the costs associated with getting to the closest airport, parking fees, and car rental fees.
Due to overtime costs associated with driving to the conference, Board Members discussed the possibility of adjusting the Court Clerk's work hours later in the week to offset Sunday travel time.
Motion by Deputy Mayor Kosmerl and seconded by Mayor Doster, Gill Moore be granted permission to attend the NYS Association of Magistrates Court Clerks Annual Conference from October 8th 11th, 2006 at the Nevele Grande Resort and Country Club in Ellenville, NY. Travel to the conference will be via vehicle, overtime (not to exceed 6 hours) will be granted for driving to the conference on Sunday, and mileage will be reimbursed in accordance with IRS guidelines.

REVIEW ADMINISTRATION OF VOLUNTEER EMERGENCY SERVICE RESPONDER LEAVE POLICY

RESOLUTION – AUTHORIZATION TO SIGN INTERNET BANKING ENROLLMENT - COURT
The following resolution was offered by Mayor Doster and later withdrawn due to the lack of a second.
RESOLUTION
RESOLVED, that the Village of Arcade is authorized to enroll for Bank of Castile Internet Banking, and that Sheri Bell Beyer, Village Justice and Gillian Moore, Court Clerk are hereby authorized to execute Internet Banking Enrollments, and/or other agreements that may be required for the Internet Banking services requested, on behalf of the Village of Arcade, in such form and content and upon such terms as deemed suitable and proper. The Village of Arcade Board will designate different or additional individuals as authorized representatives of the Village of Arcade in accordance with the Internet Banking Enrollment, if needed.
Clerk/Treasurer Beiersdorf was directed to contact the Bank of Castile Internet Banking department to discuss the banks policy on granting privileges to the Courts accounts and report her results to the Board. Ultimately, the Board wants to ensure that read-only access (versus full access) to the Courts accounts is an option prior to granting permission to sign the internet banking enrollment.

VILLAGE PARK SPRAY FOUNTAIN
Deputy Mayor Kosmerl inquired about the status of the Village Park spray fountain. Superintendent of Public Works Kilburn informed the Board that he is waiting for a response from the Wyoming County Health Department before proceeding with plans to modify the fountain. Superintendent of Public Works Kilburn was asked to post a sign indicating hours of temporary operation.
LOCAL LAW CHAPTER 64, "ZONING," SECTIONS 420 & 440
Trustee Ely presented the Board with an proposed amendment to Local Law Chapter 64, "Zoning," Sections 420 and 440.
Section 420 was revised to add the following words as a use permitted by special permit:
Section 440 was revised to add "accessory uses" as a use permitted by right in Highway Commercial/Light Industrial (HC/LI) district.
Motion by Mayor Doster and seconded by Trustee Burkett, the proposed amendment to Local Law Chapter 64, "Zoning," Sections 420 and 440 be approved as presented and Clerk/Treasurer Beiersdorf be directed to schedule a public hearing for August 15, 2006.

VILLAGE PARK HOCKEY RINK
Motion by Mayor Doster and seconded by Deputy Mayor Kosmerl, money previously allocated for trees should be reallocated to destroy and reconstruct the Village Park hockey rink. Mayor Doster will organize a group to solicit donations from local residents and businesses in anticipation of recovering funds.
