At a regular meeting of the Board of Trustees of the Village of Arcade, Wyoming County, New York held on Tuesday, February 4, 2003 at 7:00 P.M. there were:

NOTICE

Pursuant to Article 7 of the Public Officers Law, notice of this meeting was given to the media on the 24th day of January, 2003 and the same posted on the 24th day of January, 2003.

PLEDGE TO ALLEGIANCE

Mayor Doster opened the meeting with the Pledge to Allegiance.

MOMENT OF SILENCE

Mayor Doster asked for a moment of silence for the members of the crew of the Challenger who lost their lives on Saturday.

APPROVE MINUTES

Motion by Trustee Kosmerl, seconded by Trustee Comstock and unanimously carried the minutes from a regular meeting held on January 21, 2003 be approved as presented.

SET DATES FOR BUDGET WORK SESSIONS

Motion by Mayor Doster, seconded by Trustee Kosmerl and unanimously carried budget work session to be scheduled for February 11th at 6:00 p.m. and on February 18th at 6:00 p.m. (1 hour before the regular meeting) in the Village Board Room.

BUDGET ADJUSTMENTS

Motion by Trustee Kosmerl, seconded by Mayor Doster and unanimously carried the following budget adjustment be approved as presented by the Clerk:

AUDIT BILLS

Motion by Mayor Doster, seconded by Deputy Mayor Wood and unanimously carried the Village bills be audited and paid and that the clerk be granted permission to transfer funds from the money market accounts to the checking accounts to cover such bills.

LIGHTING CODE

Trustee Kosmerl handed out information regarding lighting codes for municipalities.  The reason for a code is to control issues such as glare, light trespass, energy waste, cost savings and sky glow. This would be contained in the Zoning law and would be in effect for new developments. He asked that everyone review the information and discuss at the March 4th meeting.

WINTERFEST

Motion by Deputy Mayor Wood, seconded by Mayor Doster and unanimously carried the hockey rink be used a little past 10:00 p.m. on Friday and Saturday for their tournament.

FULL TIME POLICE OFFICER

Motion by Deputy Mayor Wood, seconded by Trustee Kosmerl and unanimously carried that Ian Spencer be hired as a full time Police Officer as soon as he has successfully passed all Civil Service tests upon recommendation of Chief Laird.

ELECTRIC DEMAND CUSTOMERS

Deputy Mayor Wood inquired into the feasibility of a new rate structure that included a seasonal demand rate. After discussion this matter will be directed to our accountants to look into a new rate class and the cost of implementation.

FINAL SPECIAL FRANCHISE & RAILROAD CEILINGS RECEIVED

Clerk Offers informed the board that she had received the Final Special Franchise assessments from the State Board of Real Property Services and that they were the same as the tentative amounts received earlier.

WALKABLE COMMUNITIES

Chief Laird and Superintendent Kilburn attended the Arcade Merchants meeting this week and discussed the Walkable Communities Committee that is being formed.  They were very excited about it and will have 3-4 members serve on the committee.

POSSIBLE GRANT APPLICATIONS

There was discussion on submitting a Flood Mitigation Grant Application shortly. The cost for submitting the application is up to $4,500 of which the Village must pay one-half. The board agreed that we should submit an application.

There is also a Small Cities Block Grant Application in which Community Centers are eligible.  The cost to submit this application is up to $8,000.  The board felt that since we were already committing $2,250 which is not budgeted for the Flood Mitigation Grant Application it was not economically feasible that we also make a Small Cities Block Grant Application at this time.

 REVIEW TENTATIVE WATER BUDGET

The board reviewed the tentative 2003-04 Water Department Budget.

EXECUTIVE SESSION

Motion by Trustee Kosmerl, seconded by Mayor Doster and unanimously carried the board enter executive session to discuss a contractual matter.

Motion by Deputy Mayor Wood, seconded by Mayor Doster and unanimously carried the board exit executive session.

ELECTRIC DEPARTMENT HIRES

Motion by Trustee Kosmerl and seconded by Mayor Doster Greg Johnson be hired as a Lineman A as of April 1, 2003 and Ron Waldron be hired as a Lineman B as of March 1, 2003. The motion was adopted upon the following vote:

EXECUTIVE SESSION

Motion by Mayor Doster, seconded by Trustee Kosmerl and unanimously carried the board enter executive session to discuss a legal matter, two employee matters and the upcoming negotiations.

Motion by Deputy Mayor Wood, seconded by Mayor Doster and unanimously carried the board exit executive session.

TOWN OF FREEDOM TAXES

Motion by Deputy Mayor Wood, seconded by Mayor Doster and unanimously carried the board accept the recommendation of Attorney Robert Kutzuba regarding the proposed settlement with the revision that the water rate adjustment be effective as of June 1, 2003.

REPORTS RECEIVED

Village Justice and Acting Village Justice reports for the month of January were received, reviewed and placed on file.

Ambulance report for the month of January was received, reviewed and placed on file.
