At a regular meeting of the Board of Trustees of the Village of Arcade, Wyoming County, New York held on Tuesday, August 17, 2004, at 7:00 P.M. there were:

PRESENT

Mayor Michael Doster, Deputy Mayor Hugh Ely, Trustee Paul Burkett, Trustee Richard Kosmerl, Trustee Daniel Reisdorf, Superintendent of Public Works Larry Kilburn

ALSO PRESENT

Police Chief John Laird, Rachel George – Arcade Herald, Cyndi Gradl, Greg Schuyler, George Hezel and Alan Bliss (7:45 p.m.) 

NOTICE

Pursuant to Article 7 of the Public Officers Law, notice of this meeting was given to the media on the 4th day of August 2004 and the same posted on the 4th day of August 2004.

PLEDGE TO ALLEGIANCE

Mayor Doster opened the meeting with the Pledge to Allegiance.

APPROVE MINUTES

Motion by Trustee Burkett seconded by Trustee Ely and unanimously carried the minutes from a regular board meeting held on August 3, 2004 be approved as presented.

ARCADE AREA PARTNERSHIP - UPDATE

No one showed for this committee.

AWARD BID – STEEL SIDING – FIREHALL

Superintendent Kilburn stated the final bid he received from Just Barns, Inc. was $31,500, which is $1,500 over what was budgeted. The awarding of the bid was tabled until Superintendent Kilburn can speak to Fire Chief Neil Williams and see if the fire company can come up with the extra $1,500 which is needed.

PERFORMANCE REVIEW - IDEAS

Superintendent Kilburn presented an outline, which the salaried employees had put together; the board felt that this was going in the right direction. The board would like us to elaborate a little more on what we feel should be on this review and bring it back again to the September 7th board meeting.

DISCUSS LETTER FROM ZONING OFFICER

After discussing the letter written from Marvin Zielonka the board decided that Mayor Mike Doster should meet with Marv and try to negotiate if he could attend a meeting once a quarter to discuss any problems with the board and go over his job description. Mayor Doster will come back to the board with the results of this meeting.

AUDIT BILLS

Motion by Mayor Doster seconded by Trustee Ely and unanimously carried the Village bills be audited and paid and that the clerk be granted permission to transfer funds from the money market accounts to the checking accounts to cover such bills.

EXECUTIVE SESSION

Motion by Mayor Doster seconded by Trustee Ely and unanimously carried the board enter executive session to discuss legal matter at 7:45p.m.

Motion by Trustee Kosmerl seconded by Trustee Reisdorf and unanimously carried the board exit executive session at 7:55p.m.

STATE LOCAL DISASTER ASSISTANCE AGREEMENT

Motion by Trustee Burkett seconded by Trustee Ely and unanimously carried that Mayor Doster be authorized to sign the State Local Disaster Assistance Agreement 404 Hazard Mitigation Program.

REPORTS RECEIVED

Village Justice and Acting Village Justice reports for the month of July were received, reviewed and placed on file.

PILOT AGREEMENT NORTHRIDGE HOMES

George Hezel and Alan Bliss were present to explain the intent of the pilot agreement regarding the Village allocating or distributing as the Village sees fit (the $10,000 or 8%) between the various entities currently assessing taxes against the Project. As the board did not understand that this was the intent, the Mayor would not sign the PILOT agreement until he was able to discuss this with our Attorney and see what percent the tax burden is on each entity.  This matter was tabled until the next board meeting or special meeting.
