At a regular meeting of the Board of Trustees of the Village of Arcade, Wyoming County, New York held on Tuesday, November 4, 2003, beginning at 7:00 P.M. there were:

NOTICE

Pursuant to Article 7 of the Public Officers Law, notice of this meeting was given to the media on the 23rd day of October, 2003 and the same posted on the 23rd day of October, 2003.

PLEDGE TO ALLEGIANCE

Mayor Doster opened the meeting with the Pledge to Allegiance.

APPROVE MINUTES

Motion by Trustee Kosmerl, seconded by Deputy Mayor Ely and unanimously carried the minutes from a regular meeting held on October 21, 2003 be approved as presented.

RESOLUTION – LEASE PURCHASE AGREEMENT

The following resolution was offered by Mayor Doster and seconded by Trustee Kosmerl:

LEASE PURCHASE RESOLUTION DATED NOVEMBER 4, 2003.  A RESOLUTION
AUTHORIZING THE ENTERING INTO OF A LEASE PURCHASE AGREEMENT IN CONNECITON WITH THE ACQUISITION OF A FORK LIFT TRUCK
IN THE PRINCIPAL AMOUNT OF $9,995.00

WHEREAS, the Village of Arcade, Wyoming County, New York is in need of a fork lift truck and has evaluated financing alternatives and time involved and determined that a lease/purchase agreement is in the best interest of the Village;

NOW, THEREFORE, BE IT RESOLVED, by the Board of Trustees of the Village of Arcade, Wyoming County, New York as follows:

Section 1. The Village Treasurer is hereby authorized to execute a lease purchase agreement and any other documents required in connection with the financing of a fork lift truck at a maximum estimated cost of $9,995.00, which is to be repaid over 48 months.

Section 2. This resolution takes effect immediately.

The question of the adoption of the foregoing resolution was duly put to a vote on roll call, which resulted as follows:

RESIGNATION OF MELISSA PARKER

Motion by Mayor Doster, seconded by Deputy Mayor Ely and unanimously carried the resignation of Melissa Parker on November 1, 2003 as a part-time Police Officer be accepted with regret.

PERMISSION TO ADVERTISE FOR PART-TIME POLICE OFFICER

Motion by Mayor Doster, seconded by Trustee Kosmerl and unanimously carried Chief Laird be granted permission to advertise for the position of part-time Police Officer to fill the vacancy  of Melissa Parker.  It was determined that the position be filled by someone who has the training.

PRESENTATION OF 5-YEAR PLAN

Superintendent Kilburn presented a draft five-year plan for equipment for the Village of Arcade. This is the beginning of the budget process and each board member was asked to review the information for a future meeting.

BUDGET ADJUSTMENTS

Motion by Trustee Kosmerl, seconded by Deputy Mayor Ely and unanimously carried the following budget adjustment be approved as presented by the Clerk:

AUDIT BILLS

Motion by Mayor Doster, seconded by Deputy Mayor Ely and unanimously carried the Village bills be audited and paid and that the clerk be granted permission to transfer funds from the  money market accounts to the checking accounts to cover such bills.

RESOLUTION – BUCKLE UP NEW YORK PT-6120035

The following resolution was offered by Deputy Mayor Ely and seconded by Trustee Kosmerl:

RESOLUTION

WHEREAS, The Congress of the United States has enacted Public Law 89-564, as amended, entitled “An Act to Provide for Coordinated National Highway Safety Program Through Financial Assistance to the States to Accelerate Highway Traffic Safety Programs”, and for Other Purposes, and

WHEREAS, The Governor’s Traffic Safety Committee has been designated by the Governor, by Executive Order No. 22, dated April 27, 1967, pursuant to Article 16-A of the Executive Law, to  act on behalf of the Governor and to represent and act for the State in dealing with the Secretary of Transportation for the purpose of carrying out the provisions of said Public Law 89-564, as amended, and

WHEREAS, the Regional National Highway Traffic Safety and the Division of Federal Highway Administrators have approved the State’s current Highway Safety Work program and said Program  contains a supplement embracing the Governor’s Traffic Safety Committee approved projects applied for by municipal law agencies, and

WHEREAS, the Arcade Police Department has been awarded a grant in the amount of $2,900 for the period of October 1, 2003 to September 30, 2004 to participate in the statewide “Buckle Up”  New York campaign,

NOW, THEREFORE, Be It Resolved, that Mayor Michael Doster be empowered to execute said agreement between the Village of Arcade and the State of New York Governor’s Traffic Safety  Committee.

REVIEW FINES AND FEES SCHEDULE

After review of the information presented motion was made by Trustee Kosmerl, seconded by Mayor Doster and unanimously carried Clerk Offers be authorized to amend Chapter 34 of the laws of the Village of Arcade entitled Parking to increase the parking fine to $25.00, to raise the fee for a Tax Search to $20.00 and to repeal Chapter 30 of the laws of the Village of Arcade entitled Off Road Vehicles.

ELECTRIC RATE INCREASE

Superintendent Kilburn reported on a meeting with Will Reynolds from BST, the accountants who are preparing our rate increase filing with the PSC for the purpose of their meeting with the  PSC concerning our filing.  Even though we requested two rate increases, one effective January 2004 and one effective June 2004, the PSC considers that as one rate filing.  The dollar amount of our total request (approximately $390,000) exceeds the PSC’s limit of $300,000 for a mini-rate filing, making it a regular rate filing. A regular rate filing requires a considerable amount of additional paperwork and time, in fact an additional 11 to 24 months.  This is too much time and expense when considering our financial position.  It was also mentioned that we can apply for a rate increase no more often than once every 12 months, therefore the second increase could be no earlier than February 2005.

After much discussion on the financial condition of the department, cost cutting, efficiency studies of all departments and the undesirability of the board to increase rates, motion was  made by Mayor Doster, seconded by Trustee Kosmerl and unanimously carried that the rate filing be adjusted to a total increase just under $300,000 to be effective with the February 2004 billing.

SALE OF FIRE TRUCK

Motion by Mayor Doster, seconded by Trustee Reisdorf and unanimously carried the 1974 Fire Truck be sold to Dale McKerrow of Freedom, New York in the amount of $500.00.

EXECUTIVE SESSION

Motion by Mayor Doster, seconded by Deputy Mayor Ely and unanimously carried the board enter executive session to discuss a legal issue and contract negotiations.

Motion by Mayor Doster, seconded by Deputy Mayor Ely unanimously carried to board exit executive session.

SPECIAL MEETING

There will be a special meeting of the Board of Trustees and the Union Negotiating Team on Monday, November 10, 2003 at 3:00 p.m. in the upstairs lunchroom.

REPORTS RECEIVED

Village Justice and Acting Village Justice reports for the month of October were received, reviewed and placed on file.

Ambulance report for the month of October was received, reviewed and placed on file.
