At a regular annual meeting of the Board of Trustees of the Village of Arcade, Wyoming County, New York held on Tuesday, June 18, 2002, at 7:00 P.M. there were:

NOTICE
Pursuant to Article 7 of the Public Officers Law, notice of this meeting was given to the media on the 5th day of June, 2002 and the same posted on the 5th day of June, 2002.
PLEDGE TO ALLEGIANCE
Mayor Doster opened the meeting with the Pledge to Allegiance.
APPROVE MINUTES
Motion by Trustee Kosmerl, seconded by Trustee Comstock and unanimously carried the minutes from a regular board meeting held on June 4, 2002 be approved as presented.
COMPLAINT – BIRD ALARM AT BLUE SEAL
Tiffany Bartz, a resident of Arcade Valley Estates, came before the board to complain about a bird alarm at the Blue Seal Feed facility adjacent to her residence. She played a recording of the noise for the board. She also presented the board with a “Petition of complaint against Blue Seal for continuously playing a recording over loud speaker that asked for the noise ordinance to be enforced” that was signed by 38 people (see attached).
After a phone call from Mrs. Bartz on June 10. 2002, the Village contacted Michael Driver, Plant Manager of Blue Seal regarding the complaint. They agreed to adjust the volume down 25% and to extend the frequency of the alarm from every minute to every five minutes. They stated, however, that they would experiment with delayed setting and reducing the volume but must be emphatic that controlling the birds and thus the safety of their products must be a high priority.
Mrs. Bartz has contacted the DEC regarding this matter and they informed her that there are alternatives to the bird alarm now in use. The Village will also check into alternatives.
William Sprague, park owner, stated that Arcade Valley Estates has had continuous problems with the Industrial Park over the last ten years. While the problem with the pellet plant is better the residents still have problems with dust once or twice a week. He also stated that the trailer park was their first.
FILLING OF POOLS BY THE FIRE DEPARTMENT
Len Connelly addressed the board regarding the Village’s stance on the Fire Department filling swimming pools. He was informed that the Mayor, Superintendent and Fire Chief had been corresponding back and forth regarding this matter and that it was the opinion of all involved that there is a moratorium on filling swimming pools. After further discussion motion was made by Trustee Comstock, seconded by Mayor Doster and unanimously carried the Water Rate Schedule be amended by removing the rate for filling swimming pools.
NEW WATER RATES
Len Connelly commented on the new water rates of the Village stating that his last quarter bill will go up approximately 36% not the 20% that was stated. He was informed that it has been stated all along that the base rate would go up 20% and that the usage rate was greater. The more water that is consumed the higher the percentage of increase.
Mr. Connelly stated that the new rates were very costly for those that had swimming pools and would like the board to consider waiving the sewer rate on the gallons used to fill swimming pools. The board will discuss this matter.
AWARD BID - DUMP TRUCK
After review of the warranty agreement on the vehicle motion was made by Mayor Doster, seconded by Trustee Kosmerl and unanimously carried the bid for a dump truck be awarded to Fleet Maintenance of West Seneca, New York in the amount of $60,000.00.
ANNUAL FINANCIAL REPORT
Motion by Deputy Mayor Wood, seconded by Trustee Kosmerl and unanimously carried the Financial Cash Report for the year ending May 31, 2002 be accepted as presented. (Copy of said report is on file in the clerk’s office.)
AMEND – EMERGENCY DISASTER PLAN
Motion by Deputy Mayor Wood, seconded by Mayor Doster and unanimously carried the Emergency Disaster Plan Appendix G be updated as follows:

It was discussed that the Village contact Jim Reger, Director Fire and Emergency Services of Wyoming County to set up a seminar for Village Officials for disaster training.
DONATION – PIONEER CREDIT RECOVERY
Clerk Offers informed the board that she had been presented with a check in the amount of $2,697.50 from Pioneer Credit Recovery for use by the Arcade Recreation Program. A letter of thanks will be sent.
RESOLUTION MEUA ANNUAL MEETING
The following resolution was offered by Mayor Doster and seconded by Trustee Comstock:
RESOLUTION
WHEREAS, the Board of Trustees of the Village of Arcade, New York, is a municipal member of the Municipal Electric Utilities Association of New York State, and
WHEREAS, the annual meeting of the Municipal Electric Utilities Association of New York State has been called on August 27, 28, 29, and 30, 2002 to be held at the Sheraton Saratoga Springs Hotel, 534 Broadway At City Center, Saratoga Springs, New York, and
WHEREAS, in accordance with the bylaws of the Municipal Electric Utilities Association of New York State, each municipal member may cast one vote on each transaction properly brought before this meeting,
NOW, THEREFORE, Be It Resolved, that Superintendent of Public Works Larry A. Kilburn be and is hereby designated as the accredited delegate of the Village of Arcade, New York.

COMPUTER USE POLICY
This was tabled until the next meeting to give the board more time to review the policy.
NEW PARK
Deputy Mayor Wood reported that in discussions with various individuals, it looks like the Lion’s Club and possibly the Masons would like to be involved with the new park project at the corner of Water and Main Street. The Mayor will form a committee in the future to begin the planning stages.
PURCHASE ROLLER FROM TOWN
Superintendent Kilburn informed the board that the Town of Arcade is selling a used roller for $565.00. It will need a few parts at approximately $200.00. The budget contains a line item for $2,000 to rent a roller this year. Motion made by Deputy Mayor Wood, seconded by Trustee Ely and unanimously carried the Village purchase the roller from the Town at a cost of $565.00.
BUDGET ADJUSTMENTS
Motion by Deputy Mayor Wood, seconded by Trustee Kosmerl and unanimously carried the following budget adjustment be approved as presented by the Clerk:

AUDIT BILLS
Motion by Mayor Doster, seconded by Trustee Ely and unanimously carried the Village bills be audited and paid and that the clerk be granted permission to transfer funds from the money market accounts to the checking accounts to cover such bills.
ADELPHIA RATE INCREASE
Mayor Doster reported that Adelphia Cable will be increasing rates on August 1, 2002. Basic Service will increase $.90, Digital Cable will increase $2.00 and Advantage will increase $3.00.
SALE OF WATER TO YORKSHIRE
A letter has been received from the Town of Yorkshire stating they are not interested in purchasing their water from the Village of Arcade at this time. They would, however, like to keep the mutual aid agreement in place.
PROPOSAL TO CHANGE RENTAL ON KITCHEN FOR FIREHALL
A proposal was received from the Arcade Fire Department’s Ladies Auxiliary to change the rate for use of the kitchen when renting the Fire Hall. They would like to see a $50.00 fee with $15.00 refundable if the kitchen is left clean and nothing is broken.
The board had questions regarding anyone that rented the fire hall that did not want the kitchen – was their a fee. Could the kitchen be locked? A letter will be sent for clarification before a decision is made.
