At a regular meeting of the Board of Trustees of the Village of Arcade, Wyoming County, New York held on Tuesday, July 16, 2002, at 7:00 P.M. there were:

NOTICE

Pursuant to Article 7 of the Public Officers Law, notice of this meeting was given to the media on the 3rd day of July, 2002 and the same posted on the 3rd day of July, 2002.

PLEDGE TO ALLEGIANCE

Mayor Doster opened the meeting with the Pledge to Allegiance.

APPROVE MINUTES

Motion by Trustee Kosmerl and seconded by Trustee Ely the minutes from a regular board meeting held on July 2, 2002 be approved as presented. The motion was adopted upon the following vote:

There was an error in the bid information and will be rebid for August 6, 2002.

BID OPENING – SALE OF SURPLUS EQUIPMENT

This meeting having been duly advertised for the receival of bids for a 1992 Kodiak Dump Truck and a 1987 Ford Dump Truck the above mentioned persons were in attendance.  The following bids were received:

Motion by Deputy Mayor Wood, seconded by Trustee Kosmerl and unanimously carried the bid for the 1992 Kodiak Dump Truck be awarded to Bob Herman Construction of Machias, New York in the  amount of $8,500.00 and the bid for the 1987 Ford Dump Truck be awarded to Howard Melancon of Clarence, New York in the amount of $4,350.00.

RESOLUTION – LEASE PURCHASE AGREEMENT

The following resolution was offered by Mayor Doster and seconded by Deputy Mayor Wood:

LEASE PURCHASE RESOLUTION DATED JULY 16, 2002. A RESOLUTION AUTHORIZING THE ENTERING INTO OF A LEASE PURCHASE AGREEMENT IN CONNECITON WITH THE ACQUISITION OF A DUMP TRUCK IN THE PRINCIPAL AMOUNT OF $60,000

WHEREAS, the Village of Arcade, Wyoming County, New York is in need of a dump truck and has evaluated financing alternatives and determined that a lease/purchase agreement is the least  expensive and is therefore in the best interest of the Village;

NOW, THEREFORE, BE IT RESOLVED, by the Board of Trustees of the Village of Arcade, Wyoming County, New York as follows:

Section 1. The Village Treasurer is hereby authorized to execute a lease purchase agreement and any other documents required in connection with the financing of a dump truck at a maximum estimated cost of $60,000, which is to be repaid over two years.

Section 2. This resolution takes effect immediately.

The question of the adoption of the foregoing resolution was duly put to a vote on roll call, which resulted as follows:

The resolution was thereupon declared duly adopted.

RESOLUTION PROPOSED LOCAL LAW 3-2002 – SEWER RENTS

The following resolution was offered by Trustee Kosmerl and seconded by Trustee Comstock:

RESOLUTION

WHEREAS, residents of the Village of Arcade have requested that the sewer rates reflect the gallons of water used to fill swimming pools and do not enter the sewer system, and

WHEREAS, the Village of Arcade has reviewed the situation and requested an amendment to Chapter 52 Sewer Rents to allow an annual $20.00 refund on sewer bills to anyone who uses more than 10,000 gallons and files and annual application, and

WHEREAS, a draft copy of the proposed Local Law No. 3-2002 adding the definition of a swimming pool and an annual reduction of $20.00 on their sewer bill upon filing an annual application  with the Village was reviewed by each Board member at the board meeting held on July 16, 2002,

NOW, THEREFORE, Be It Resolved, that the Board publish Notice of Public Hearing to be held in accordance with the provision of Section 20 of the Home Municipal Rule Law, to be held on the  6th     day of August, 2002 at 7:00 p.m. in the Village Board Room, 17 Church Street, Arcade, New York, at which time all interested persons will be heard.

COMPUTER USE POLICY

The computer use police prepared by Trustee Kosmerl was review by the board. The Clerk was directed to redo the policy in a Village format with changes that were discussed incorporated. The final form of the policy will be reviewed at the next regular meeting.

BUDGET ADJUSTMENTS

Motion by Deputy Mayor Wood, seconded by Trustee Ely and unanimously carried the following budget adjustment for the fiscal year 2002-2003 be approved as presented by the Clerk:

AUDIT BILLS

Motion by Mayor Doster, seconded by Trustee Ely and unanimously carried the Village bills be audited and paid and that the clerk be granted permission to transfer funds from the money  market accounts to the checking accounts to cover such bills.

BIRD ALARM AT BLUE SEAL

Chief Laird reported that he talked with the complainant on the bird alarm at Blue Seal and was informed that the volume has been decreased and is livable during the week but still  annoying on the weekends.  Chief Laird spoke with Blue Seal and they will try turning the volume done another notch on the weekends.

WILLIAMS STREET

Blue Seal is considering an expansion of their facility located on Williams Street.  They would like to know if the Village would be willing to allow Blue Seal to take over Williams Street from the joint property line between C&G Electric and them. Information received from Attorney Robert Kutzuba states that the easiest way is that the village would give to Blue Seal whatever portion of the street the village wants to get rid of, however, this would be giving away public land without proper consideration. Proper consideration could be had through an exchange for real property Blue Seal would be willing to part with, possibly in the form of a turn around. The Village Board was in favor of looking into this matter.

EXECUTIVE SESSION

Motion by Trustee Kosmerl, seconded by Trustee Ely and unanimously carried the board enter executive session to discuss a personnel matter and a contractual matter.

Motion by Deputy Mayor Wood, seconded by Trustee Kosmerl and unanimously carried the board exit executive session.

REPORTS RECEIVED

Fire Department report for the month of June was received, reviewed and placed on file.

Ambulance reports for the month of June was received, reviewed and placed on file.

There being no further business to come before the board the meeting duly adjourned at 8:25 p.m. upon motion by Deputy Mayor Wood and seconded by Mayor Doster.
