At a regular meeting of the Board of Trustees of the Village of Arcade, Wyoming County, New York held on Tuesday, February 5, 2002 at 7:00 P.M. there were:

NOTICE
Pursuant to Article 7 of the Public Officers Law, notice of this meeting was given to the media on the 17th day of January, 2002 and the same posted on the 17th day of January, 2002.
PLEDGE TO ALLEGIANCE
Mayor Doster opened the meeting with the Pledge to Allegiance.
APPROVE MINUTES
Motion by Trustee Kosmerl, seconded by Deputy Mayor Wood and unanimously carried the minutes from a regular meeting held on January 15, 2002 be approved as presented.
APPOINTMENT OF HUGH ELY AS TRUSTEE TO FILL TERM OF EDWARD BARBER
Mayor Doster recommended the appointment of Hugh P. Ely as Trustee to fill the remaining term of Edward Barber who passed away unexpectedly on January 14, 2002. The recommendation was approved upon motion by Deputy Mayor Wood, seconded by Trustee Kosmerl and unanimously carried.
WINTERFEST ESSAY CONTEST
Alison Wood requested that the Village Board judge the essays of the King and Queen candidates for the Winterfest. They are to read and score them on a basis of 1-10 for readability, creativity and content. The members graciously accepted.
FABULOUS 50’S COMMITTEE
Harold Burch and John Laird from the Fabulous 50’s Committee presented a tentative budget to the Board. They requested that the board consider including overtime in the Police Department budget for this event. Last year the expense for overtime was approximately $1,500. John stated that he has permission from the Police Academy to use the recruits on Friday night. Chief Laird predicts that the overtime won’t be much more than last year. The board felt that it was extremely important to be in contact with any of the merchants that may be affected by Main Street being shut down and to work out all concerns.
APPOINTMENT OF INSPECTOR OF ELECTIONS
The following resolution was offered by Mayor Doster and seconded by Trustee Kosmerl:
RESOLUTION
WHEREAS, the Village of Arcade appointed two Inspectors of Elections and an Alternate at it’s meeting held on January 15, 2002, and
WHEREAS, Janet Ely is unable to fill the appointment as a family member has accepted the nomination of the Republican Party to run for a two-year term as Trustee of the Village of Arcade,
NOW, THEREFORE, Be It Resolved, that Valerie Gray be appointed as Inspector of Elections for the elections to be held on March 19, 2002.

FINAL SPECIAL FRANCHISE & RAILROAD CEILINGS RECEIVED
Clerk Offers informed the board that she had received the Final Special Franchise assessments and the Final Railroad Ceilings from the State Board of Real Property Services and that they were the same as the tentative amounts received earlier.
PROPERTY YARD MAINTENANCE
Mayor Doster stated that a letter had been received from the Arcade Planning Board stating that inclusion of maintenance criteria for residential building and grounds is not a zoning issue as it does not have to do with dimension requirements or allowed uses. Deputy Mayor Wood states that the board has not received any specific requested from the residents to have a law of this nature. He would like to see the impetus come from the electorate not from the government. Information on specific situations to be gathered for the next meeting.
REVIEW DRAFT TELECOMMUNICATIONS LAW
The Arcade Planning Board has drafted a Telecommunications Law for the Village of Arcade. The law has comments in red and recommended additions and/or changes to the Town of Arcade’s law in blue. After a brief discussion the board tabled this matter to have time to review the draft law.
ENGINEERING WORKSHOP
Motion by Mayor Doster, seconded by Trustee Kosmerl and unanimously carried three members of the Electric Department be granted permission to attend the MEUA Engineering Workshop in Syracuse, New York on February 20 and 21 at Village expense.
LONG RANGE PLANNING
The board reviewed where we stood on various issues. Deputy Mayor Wood and Chief Laird will meet before the next meeting to review the Fines and Penalties. One issue from the UB study is the matter of assessment of public attitudes as part of the study. This is accomplished through the use of focus groups and/or telephone survey of a random sampling of village residents. Motion by Mayor Doster, seconded by Trustee Comstock and unanimously carried UB be granted permission to randomly contact village residents.
BUDGET ADJUSTMENTS
Motion by Mayor Doster, seconded by Trustee Kosmerl and unanimously carried the following budget adjustment be approved as presented by the Clerk:

AUDIT BILLS
Motion by Mayor Doster, seconded by Deputy Mayor Wood and unanimously carried the Village bills be audited and paid and that the clerk be granted permission to transfer funds from the money market accounts to the checking accounts to cover such bills.
WYOMING COUNTY VILLAGE ASSOCIATION
A notice has been received from the Village of Wyoming that in April it will be the Village of Arcade’s turn to serve as President and Secretary of the Association.
ICE STORM IN AKRON
On Friday, February 1st the Village of Arcade sent Mike McElheney and Brian Lane with a bucket truck to help the Village of Akron restore electric to its residents due to an ice storm.
SCHOOL ZONE
Superintendent Kilburn to check with DOT to see how we can get flashing light to warn motorists of a school zone.
ELECTRONIC FUNDS TRANSFER AGREEMENT EXECUTION AUTHORITY
The following resolution was offered by Mayor Doster and seconded by Trustee Kosmerl:
RESOLUTION
RESOLVED: That the Village of Arcade (the corporation) is authorized to enter into Electronic Funds Transfer Agreements (“EFT Agreements”) including but not limited to; Funds Transfer Agreements, Agreements for the Automatic Transfer of Credits and/or Debits, and Trust Company Internet Banking Enrollments, with The Bank of Castile, and that the least one of the following persons:

Janet R. Payne Deputy Clerk-Treasurer
Be and hereby are authorized to execute on behalf of this Corporation, such EFT Agreements with The Bank of Castile in such form and content and upon such terms as she deems suitable and proper; and hereby are authorized to designate different or additional individuals as authorized representatives of this Corporation in accordance with the particular EFT Agreement.

WASTEWATER TREATMENT SCHOOL
Motion by Mayor Doster, seconded by Trustee Kosmerl and unanimously carried permission be granted for one or two Sewer Department employees to attend a Wastewater Treatment School in Old Forge, New York on March 24-29 at Village expense.
SLEDDING PARTY
A request was received from the Pioneer FFA to have a sledding party at the Village Park on March 2nd from noon to 4:00 p.m.
REVIEW TENTATIVE WATER BUDGET
The remainder of the meeting was spent reviewing the tentative 2002-03 Water Department Budget.
REPORTS RECEIVED
Village Justice and Acting Village Justice reports for the month of January were received, reviewed and placed on file.
Ambulance report for the month of January was received, reviewed and placed on file.
