At a regular meeting of the Board of Trustees of the Village of Arcade, Wyoming County, New York held on Tuesday, February 19, 2002 at 7:00 P.M. there were:

PLEDGE TO ALLEGIANCE
Deputy Mayor Wood opened the meeting with the Pledge to Allegiance.
APPROVE MINUTES
Motion by Trustee Comstock, seconded by Trustee Ely and unanimously carried the minutes from a regular meeting held on February 5, 2002 be approved as presented.
ERIC SLOCUM – ARCADE-KNIGHT AGENCY – LIABILITY INSURANCE
Eric Solcum from Arcade-Knight Agency was present to discuss the volatility of the insurance industry. The board wanted to know if there was a different time that the village can buy insurance that it wouldn’t go up during the budget year. It was explained that quotes are not received until a month in advance of policy renewal. With the Village’s budget process of having a tentative budget in place by March 31st there is no way to have a firm number at that time. The rate increase seen this year had nothing to do with September 11th. The market was spiraling before then. The competition has dried up as the market became hard. The Village and Arcade-Knight Agency are currently gathering information for next years policy with request for quotes going to New York Municipal Insurance Reciprocal, Trident Insurance and St. Paul. It is the intention of Arcade-Knight Agency to provide coverage with financially stable insurance carriers at fair and competitive rates. Eric explained the differences between NYMIR and other insurance companies.
Asked what the Village can do to control or reduce costs Eric stated have loss control measures in place or don’t have claims. It is a hard question to answer because at the time the Village was having some claims it was a soft market that was driving the costs down. The market really controls reducing the premium.
JOHN BRAY – DAMAGE TO VEHICLE AT VILLAGE PARK
John Bray informed the board that he hit a guy wire in the park on Winterfest weekend that was not marked which caused damage to his vehicle. Superintendent Kilburn stated that someone had tampered with the sleeve that is normally on the wire and pushed it up so that it was ineffective. It has been fixed and clipped into place. The Village has already turned in Mr. Bray’s claim to Arcade-Knight Agency. The village will look into what else could be done that is more visible to protect motorists in the future.
RESOLUTION - PROPOSED LOCAL LAW 1-2002 - ZONING
After a brief discussion the following resolution was offered by Deputy Mayor Wood and seconded by Trustee Kosmerl:
RESOLUTION
WHEREAS, the Village Board of the Village of Arcade received a request from the Arcade Planning Board to amend Chapter 64 entitled Zoning of the Laws of the Village of Arcade, and
WHEREAS, the request is to amend Article 800 Supplemental Regulations to add Section 816 Telecommunications Facilities, and
WHEREAS, the Village of Arcade adopted a Moratorium on Telecommunications Facilities on September 18, 2001 that was in effect for 180 days, and
WHEREAS, the Arcade Planning Board has requested that the Village delete radio and television towers from uses permitted by Special Permit under Sections 401 CR District, 415 AG District, 430 LI District and 440 HC/LI, and
WHEREAS, the Arcade Planning Board has requested that the Village add telecommunication towers under uses permitted by Special Permit under Sections 415 AG District and 440 HC/LI District, and
WHEREAS, a draft proposal of proposed Local Law No. 1-2002 amending Chapter 64 regarding Zoning has been reviewed by each Board member at the board meeting held on February 19, 2002,
NOW, THEREFORE, It is Hereby:
1. Resolved, that Article 800, Section 816 – Telecommunication Towers be added to Chapter 64 of the Laws of the Village of Arcade and that Sections 401, 415, 430 and 440 be amended as stated above, and
2. That a copy of the proposed Local Law has been forwarded to the Wyoming County Planning Board for its review on March 4, 2002 pursuant to Section 239-m of the General Municipal Law, and
3. That the Village Clerk be directed to publish a Notice of Public Hearing to be held by this Board on the 7th day of March 2002 considering said Local Law to add Telecommunication Facilities to the Zoning Law of the Village of Arcade, and
4. That said Clerk publish a notice of said hearing at least ten (10) days in advance of such hearing in the official newspaper of the Village (Section 1403).
5. That the Village Clerk give notice of proposed zoning change to the Clerk of the Town of Arcade at least ten (10 days prior to the date of such hearing (section 1403 (a) (1)).

RESIGNATION FROM PLANNING BOARD
Motion by Deputy Mayor Wood, seconded by Trustee Kosmerl and unanimously carried the board accept, with deep regret, the resignation of Cheryl Park from the Arcade Planning Board. The board stated that they were very impressed with the work that Cheryl had preformed while serving as a member and have been an invaluable source of information.
PERMISSION TO POST WATER POSITION
Motion by Trustee Kosmerl, seconded by Trustee Comstock and unanimously carried permission be granted to Superintendent Kilburn to post an entry level position in the Water Department on March 1st with the position to be filled on April 1st.
BUDGET ADJUSTMENTS
Motion by Deputy Mayor Wood, seconded by Trustee Kosmerl and unanimously carried the following budget adjustment is approved as presented by the Clerk:

AUDIT BILLS
Motion by Deputy Mayor Wood, seconded by Trustee Kosmerl and unanimously carried the Village bills be audited and paid and that the clerk be granted permission to transfer funds from the money market accounts to the checking accounts to cover such bills.
STREET SURVIVAL TRAINING
Motion by Deputy Mayor Wood, seconded by Trustee Ely and unanimously carried Matt Krist be granted permission to attend Street Survival Training in Buffalo on March 12-14 at Village expense.
WATER DRAINAGE PROBLEM
A letter was received from Timothy Sanford (Arcade Dental Arts) regarding an ongoing drainage problem on his property. Superintendent Kilburn has been in contact with the State DOT regarding this matter with no results. The board requested that letters be sent to Senator Dale Volker and Assemblyman Dan Burling regarding this matter along with letters to the Warsaw and Rochester DOT offices.
BEAUTIFICATION COMMITTEE
A letter was received from the Beautification Committee requesting an amount of $1,600 be included in the 2002-2003 budget to outline the Arcade Pennysaver, Arcade Herald and Masonic Temple with lights and to put lights in the trees on the south side of Main Street.
A grant has been awarded to Pioneer Elementary School to paint a mural on the side of the Howlett building this year. Who is responsible for the insurance was discussed.

The following resolution was offered by Trustee Kosmerl, seconded by Deputy Mayor Wood and unanimously carried:

CHANGE MEETING DATE & SET WORK NIGHTS
Motion by Deputy Mayor Wood, seconded by Trustee Kosmerl and unanimously carried the second board meeting in March be changed from Tuesday, March 19, 2002, to Wednesday, March 20, 2002 due to Village Elections.
Motion by Deputy Mayor Wood, seconded by Trustee Kosmerl and unanimously carried that a work night for the budget be scheduled for Thursday, March 7th in the Village Meeting Room on the second floor.
PERMISSION TO USE VILLAGE STREETS AND SIDEWALKS
The Village Board approved the March of Dimes to hold their annual Walk American on Saturday, April 27, 2002 from 10:00 a.m. to 2:00 p.m. in the Village of Arcade.
SOLID WASTE COLLECTION
Motion by Trustee Ely, seconded by Trustee Kosmerl and unanimously carried Superintendent Kilburn be granted permission to check with CID Waste Management to see if the renewal price on service will remain the same as prior years, if not, go to bid for solid waste collection for the 2002-2003 budget year.
BUDGET WORK SESSION
The remainder of the meeting was spent reviewing the proposed water and general budgets.
Motion by Trustee Kosmerl, seconded by Deputy Mayor Wood and unanimously carried the board enter executive session to discuss a contract issue.
Motion by Trustee Kosmerl, seconded by Deputy Mayor Wood and unanimously carried the board exit executive session.
