At a regular meeting of the Board of Trustees of the Village of Arcade, Wyoming County, New York held on Tuesday, August 27, 2002, at 7:00 P.M. there were:

NOTICE

Pursuant to Article 7 of the Public Officers Law, notice of this meeting was given to the media on the 8th day of August, 2002 and the same posted on the 8th day of  August, 2002.

Mayor Doster opened the meeting with the Pledge to Allegiance.

APPROVE MINUTES

Motion by Trustee Kosmerl , seconded by Trustee Comstock and unanimously carried the minutes from a regular board meeting held on August 6, 2002 be approved as presented.

BID OPENING – 4 WHEEL DRIVE DIGGER DERRICK

This meeting having been duly advertised to receive bids for the purchase of a 4-wheel drive digger derrick for the Electric Department the above listed people were in attendance.   The following bids were received:

Motion by Deputy Mayor Wood, seconded by Trustee Kosmerl and unanimously carried the bid be turned over to the Superintendent of Public Works for his review and recommendation.

PUBLIC HEARING – PROPOSED LOCAL LAW 4-2002 RETIREMENT INCENTIVE

Mayor Doster opened the public hearing for the possibility of offering the State of New York’s Retirement Incentive Plan to Village employees who are eligible.  There are eleven  employees that are eligible for the incentive, however, only one employee has expressed any interest.

Clerk Offers presented the board with the estimated costs and savings for each eligible employee which was discussed.  The projected earnings for each employee was derived at using last year’s W-2 wages plus an arbitrary 3% increase.  If someone does retire the Village has the option of paying the retirement system either in a lump sum or over a five-year period.  The payback is at the option of the Village.

When Mr. Schuyler asked where the 3% projected increase came from he was informed that it was just an arbitrary figure based on history.  The current union contract runs out May 31, 2003 and negotiations will begin in January.  The Mayor stated that the 3% was not in anyway decided upon by the board and that it was based on history of the last four-year contract for purposes of determining a possible cost or savings to the Village for the incentive.

Mr. Reisdorf asked if we had anything in our employee policy that requires an employee to give advanced notice of date they are going to retire?  At this time the Village does not require any advanced notice other than what is required by the retirement system and do not plan to put it in the handbook at this time.

When asked what would happen if everyone that were eligible retired this year, the Clerk stated that she couldn’t see that happening.  There are milestones in the retirement system. After either 5-10 years you become vested, at 20 years that is a sizeable increase in your retirement income and at 30 years you are eligible for full retirement benefits.  Between the 20 – 30 year period the benefits increase by a fraction of a percentage every month.  Many of the people on the list are not at the 20 year level but under the terms of the incentive are eligible because they are 50 years of age with 10 years of service credit or 55 years of age with 5 years of service credit.

Mayor Doster felt that the incentive would be a good thing as it could benefit the dedicated employee who has put so many years in with the village and it could also benefit the village.

There being no further questions or comments the public hearing was closed at 7:25 PM.

ADOPT LOCAL LAW 4-2002 RETIREMENT INCENTIVE

The following resolution was offered by Mayor Doster and seconded by Deputy Mayor Wood:

RESOLUTION

WHEREAS, a proposed Local Law to add Chapter 47B to the Laws of the Village of Arcade entitled Retirement Incentive was reviewed by the Board members on the 6th day of August, 2002, and

 

WHEREAS, the Village Clerk has certified that the Open Meetings Law has been complied with regarding the calling of a meeting of the Board of Trustees which was held on the 6th day of August, 2002, and at such meeting a Resolution was adopted to schedule a public hearing on said proposed Local Law on the 27th day of August, 2002, and

WHEREAS, the final form of Proposed Local Law 4-2002 was delivered to the desk of each board member on the 6th day of August, 2002, and

WHEREAS, the Notice of said public hearing was published in the Arcade Herald on the 15th day of August, 2002, and

WHEREAS, the Village Clerk has certified that the Open Meetings Law has been complied with in regards to the Public Hearing called on the 27th day of August, 2002, and this Board having met on that day and conducted said public hearing and considered such arguments as were presented for and against the adoption of Proposed Local Law No. 4-2002, and

WHEREAS, the Village Clerk has certified that the Open Meetings Law has been complied with in regards to this meeting;

NOW, THEREFORE, Be It Resolved, as follows:

THAT Proposed Local Law No. 4-2002 of the Village of Arcade as presented at the public hearing be and the same be enacted to read as follows:

CHAPTER 47-B

RETIREMENT INCENTIVE PROGRAM

A Local Law electing a retirement incentive program as authorized by Chapter 69, Laws of 2002 for the eligible employees of the Village of Arcade.

BE IT ENACTED by the Board of Trustees of the Village of Arcade, as follows:

SECTION 47-1.

The Village of Arcade hereby elects to provide all its eligible employees with a retirement incentive program authorized by Chapter 69, Law of 2002.

SECTION 47-2.

The commencement date of the retirement incentive program shall be October 3, 2002.

SECTION 47-3.

The open period, during which eligible employees may retire and receive the additional retirement benefit, shall be 90 days in length.

SECTION 47-4.

The actuarial present value of the additional retirement benefits payable pursuant to the provisions of this local law shall be paid as one lump sum, or  in five annual installments. The amount of the annual payment shall be determined by the Actuary of the New York State and Local Employees’ Retirement System, and it shall be paid by the Village of Arcade.

SECTION 47-5.

This act shall take effect September 3, 2002.

COMPUTER USE POLICY

After discussion and review a motion was made by Trustee Kosmerl, seconded by Deputy Mayor Wood and unanimously carried the following Computer Use Policy be adopted by the Village of Arcade effective October 1, 2002:

COMPUTER USE POLICY

PURPOSE

1.0 To define the policy and responsibilities necessary to ensure appropriate, efficient and responsible use of computer resources.

2.0  To ensure that computer resources are used in compliance with applicable laws and software license agreements.

BUDGET ADJUSTMENTS

Motion by Mayor Doster, seconded by Trustee Kosmerl and unanimously carried that the following budget adjustments be approved as requested by the Clerk-Treasurer:

AUDIT BILLS

Motion by Mayor Doster, seconded by Trustee Kosmerl and unanimously carried the Village bills be audited and paid and that the clerk be granted permission to transfer funds from the money  market accounts to the checking accounts to cover such bills.

NATIONAL FUEL GAS EXCAVATION

National Fuel Gas is to be notified of a hazardous area on Water Street where a hole is not properly secured.

ARCADE YOUTH FOOTBALL ASSOCIATION

A letter was received from the Arcade Youth Football Association requesting that the additional lighting that was agreed upon last year for the outside of the Boy Scout building and park  cabin be installed. They also requested that both board meet so that all involved will have an opportunity to give their input.  The Clerk was instructed to invite the AYFA Board to the September 3rd meeting.

FINAL EQUALIZATION RATE

The State Board of Real Property Services has notified the Village that the Final State Equalization Rate for the 2002 Assessment Roll is 101.89.

UPGRADE TO LINEMAN A

Motion by Trustee Comstock, seconded by Trustee Ely and unanimously carried Brian Lane be upgraded to Lineman A effective August 19, 2002 as was budgeted.

EFFECIENCY STUDY

Clerk Offers informed the board that she had received correspondence from John Sheffer stating that it was his hope to wrap up the project in September.

TRAINING FOR PLANNING AND ZONING BOARDS

After discussion with Planning Board member Paul Bijhouwer and Cheryl Parker the board will look into the possibility of having a training session in Arcade for anyone who is interested.  It was felt that member of the Planning and Zoning Boards need to have training so that there is continuity between the various boards and the Zoning Officer.
