At a regular meeting of the Board of Trustees of the Village of Arcade, Wyoming  County, New York held on Tuesday, May 1, 2001, at 7:00 P.M. there were:

Deputy Mayor Frank Wood, Trustee Edward Barber, Trustee Ginger Comstock, Trustee Rich Kosmerl, Superintendent of Public Works Larry Kilburn

ABSENT

Mayor Michael Doster

Police Chief John Laird, Cheryl Parker, Greg Schuyler

NOTICE

Pursuant to Article 7 of the Public Officers Law, notice of this meeting was given  to the media on the 18th day of April, 2001 and the same posted on the 18th day of April, 2001.

APPROVE MINUTES

Motion by Trustee Barber, seconded by Trustee Kosmerl and unanimously carried the  minutes from a regular board meeting held on April 17, 2001 be approved as presented. 

BID OPENING - FUEL

The meeting having been duly advertised for the receival of bids for fuel the above  named people were present.  The following bids were received:

Motion by Trustee Barber, seconded by Trustee Comstock and unanimously carried the  bids be turned over to Superintendent of Public Works Larry Kilburn for his review and recommendation.

PLANNING BOARD AND ZONING BOARD OF APPEALS PROCEDURES AND STATUS OF PERMITS

Trustee Barber prepared a summary of Building and Special Use Permit procedures  that he reviewed with the board.  After much discussion on the procedures it was determined that more information was needed and that not every application needs the same information.  Trustee Barber will do some additional work on the procedures and represent them at a future date.  The clerk also gave the board a report on Zoning Permits issued this current fiscal year and their  status.  The board requested that this be updated and presented quarterly.

BUDGET ADJUSTMENTS

Motion by Trustee Barber, seconded by Trustee Comstock and unanimously carried the  following budget adjustment be approved as presented by the Clerk:

AUDIT BILLS

Motion by Deputy Mayor Wood, seconded by Trustee Kosmerl and unanimously carried  the Village bills be audited and paid and that the clerk be granted permission to transfer funds from the money market accounts to the checking accounts to cover such bills.

MOUNTED PATROL SCHOOL

Motion by Deputy Mayor Wood, seconded by Trustee Kosmerl and unanimously carried  Sgt. John Rix and Officer Michael Hamm be granted permission to attend a Mounted Patrol Crowd Control School near Geneseo on May 4, 2001.

VILLAGE CROSS WALKS

Marked crosswalks in the Village were discussed.  Superintendent Kilburn informed the board that he had applied to the Wyoming County DOT for permission to put a pedestrian crossing sign at the railroad tracks that was denied as it is not an intersection with any street.  He was asked to check on any appeal process.  Superintendent Kilburn also informed the board that the Genesee Transportation Council would be doing a study this summer to address the  pedestrian traffic in downtown Arcade.

HAZARD MITIGATION GRANT RESOLUTION

The following resolution was offered by Deputy Mayor Wood and seconded by Trustee  Barber:

RESOLUTION

WHEREAS, certain homes in the Village of Arcade have been subjected to repeated flooding, and

WHEREAS, an agreement was reached with the property owner for the sale of three  homes to the Village of Arcade, and

WHEREAS, on May 25, 2000 the Village of Arcade submitted a grant application to the Federal Emergency Management Agency (through the New York State Emergency Management Office) for the purchase and removal of the three homes, and

WHEREAS, FEMA awarded a grant, known as Hazard Mitigation Grant #1296-6081-0019, in an amount of $126,747 for the purchase and removal of homes at 6 Water Street, 8 Water Street and 199 Main Street, and

WHEREAS, the grant provides for a 75% federal share ($95,060) and a 25% local share  ($31,687) in cash or force account work, and

WHEREAS, the grant requires the properties to be purchased no later than November 30, 2001 and the site restoration to be completed by February 28, 2002,

NOW, THEREFORE BE IT RESOLVED, by the Trustees of the Village Board, Village of  Arcade that Mayor Michael Doster be empowered to enter into an agreement with the New York Emergency Management Office ant to sign said grant agreement.

ARCHEOLOGICAL SURVEY

Motion by Deputy Mayor Wood, seconded by Trustee Comstock empowered the Mayor to  enter into an agreement with Miller and Associates to do an archeological survey that includes a background search and field recognizance in the amount of $2,000 for the three properties the village will be purchasing through the Hazard Mitigation Grant.

SCHOOLING

Motion by Trustee Kosmerl, seconded by Trustee Barber and unanimously carried Al Noble and Dave Carr be granted permission to attend a water school in Houghton, New York on May 16, 2001 at village expense.

REPORTS RECEIVED

Village Justice and Acting Village Justice reports for the month of April were  received, reviewed and placed on file.

Receipts and Disbursement reports for the month of January, February and March were  received, reviewed and placed on file.
