At a regular meeting of the Board of Trustees of the Village of Arcade, Wyoming County, New York held on Tuesday, October 17, 2000, at 7:00 P.M. there were:

APPROVE MINUTES

Motion by Trustee Barber, seconded by Deputy Mayor May and unanimously  carried the minutes from a regular board meeting held on October 3, 2000 be approved as presented.

ROD SERGEL - RMS ASSOCIATES - PARKS STREET/DEACON DRIVE DRAINAGE STUDY

Rod and Marlene Sergel from RMS Associates addressed the board and those  present regarding a recent study of three water sheds that run off into the Park Street/Mill Street/Deacon Drive.  It is the hope of the Village that their proposed remedial plan will help preclude further flooding off Park Street hill. 

Mr. Sergel explained that the Village is dealing with three watershed  areas.  Watershed E1 is south of Sullivan Park Area, Watershed W1 is south of the Cemetery and Watershed 3 is south of Rules/Prestolite.  In designing flood control structures the following things must be considered:

1. Determine amount of water to control (runoff)

  • 2. Determine characteristic of land draining into the site
  • 3. Determine Hazard Classification (Downstream Characteristics)
  • 4. Once the amount of runoff is determined, have to decide how to take care of, then, how much can be released safely (pipe sizes), and how much needs to be stored (pond size)
  • 5. Survey for topography
  • 6. Obtain approval from DEC
  • The watershed area south of Sullivan Park area has a hazard classification "C" with a drainage area of 242 acres.  There is not much choice but to go with a flood control dam.  With a flood control dam the amount to be released will be  whatever the existing culvert and the area is capable of taking without flooding other properties and causing damages.  The excess storage would require 98.3 acres feet (acre foot = 1' deep over  an acre of 326,000 gallons per acre foot).  There are two alternate sites - one than has an existing pond just up from the construction of a new home at an estimated cost of $360,590 plus land acquisition with a dam height of 40'.  The other site is up in the wooded area not too far from the cul-de-sac on Mt. View Drive at an estimated cost of $283,000 plus land acquisition with a dam height of 35'.  The one off Mt. View would probably cause the least disturbance to any residence or the environment.  The dam itself would be a dry dam with no water at normal times.  It will be designed to hold a 100 year flood.

    To the west of Park Street is another watershed that flows into the pasture area just south and east of the Arcade Rural Cemetery.  For design purposes this area was broken down into two sub-watersheds.  One is shorter and wider and the other is a long watershed.  Each one was calculated individually to determine what the peak flow would be in the area so a structure could be designed just immediately south of the cemetery to hold and carry  the water and release only the amount that could be handled by the bridge at the cemetery.  The bridge is in bad shape and needs to be repaired but cannot be any larger or it could cause damage  downstream.  The estimated cost for this site is $416,230 plus land acquisition with a dam height of 30'.

    There was discussion and questions from the public regarding which  retention pond would protect what area, debris in ditches, culvert and stream maintenance, responsibility of ditches and culverts on private property, homeowners responsibility and safety issues of children around retention ponds.

    The Village, with the assistance of its grants writers, are in the process of putting together a grant that must be submitted by October. 31st.  It was stressed to those present that it is imperative they return the survey of flood damage which were  delivered to the properties affected.  The grants are scheduled to be awarded in January and if awarded a grant the design and land purchase issued would take approximately one year before  construction could begin.

    Mayor Doster stated that he would keep everyone informed.

    NEW TRUCK FOR THE HIGHWAY DEPARTMENT

    After a presentation by Superintendent of Public Works Larry Kilburn and  Highway Forman Don Norton the board moved to the parking lot to view the type of truck the department would like and the truck and equipment they are presently using.  After discussion regarding what is currently in the budget for a truck, the price of the truck wanted and financing options motion was made by Trustee Wood, seconded by Deputy Mayor Miller and unanimously carried permission be  granted to the Superintendent to bid for a truck with snowplow, wing and sander box.  The truck will be purchased under a lease purchase agreement.  The bids will be opened on November 7th.

    DISCUSSION HOME BASED BUSINESSES

    After discussion Trustee Ed Barber volunteered to rewrite the section on Home Based Business so that it is not as cumbersome and bring it back to the next meeting for the board's review.

    DONNA FIEDLER - REMOVAL OF OUT DOOR LIGHT

    Motion was made by Trustee Barber that the Village of Arcade obtain an  easement from Mrs. Fiedler for permission to go on her property and set a pole with a light on it.  Mrs. Fiedler would be responsible for the hookup of the electricity and the maintenance of the  light.  The motion failed to receive a seconded.  After discussion the matter was tabled until the next meeting.

    RESOLUTION - 1996 CLEAN WATER/CLEAN AIR BOND ACT - TITLE 3 FLOOD CONTROL PROJECTS

    The following resolution was made by Trustee Wood and seconded by Mayor  Doster:

    Flood Control Project

    Municipal Resolution

    Resolution authorizing the items listed below pursuant to the Clean  Water/Clean Air Bond Act of 1996.

    WHEREAS, the Village of Arcade herein called the "Municipality", after thorough consideration of the various aspects of the problem and study of available data, HAS HEREBY DETERMINED THAT CERTAIN WORK, AS DESCRIBED IN ITS APPLICATION AND  ATTACHMENTS, HEREIN CALLED THE "Project", is desirable, is in the public interest, and is required in order to implement the Project; and

    WHEREAS, Article 56 of the Environmental Conservation Law authorizes  State assistance to municipalities for flood control projects by means of a contract and the Municipality deems it to be in the public interest and benefit under this law to enter into a contract therewith:

    NOW THEREFORE BE IF RESOLVED BY the Board of Trustees of the Village of  Arcade:

    1. That Mayor Michael Doster is the representative authorized to act in behalf of the Municipality's governing body in all matters related to State assistance under ECL Article 56, Title 3.  The  representative is also authorized to make application, execute the State Assistance Contract, submit Project documentation, and otherwise act for the Municipality's governing body in all matters related to the Project and to State assistance;

    2. That the Municipality agrees that it will fund its portion of the cost of the Project and that funds will be available to initiate the Project's work within twelve (12) months of written approval of its application by the Department of Environmental Conservation;

    3. That one (10 certified copy of this Resolution be prepared and sent  to the Albany office of the New York State Department of Environmental Conservation together with the Application for State Assistance Payments for Flood Control Projects;

    4. That this Resolution take effect immediately.

    LETTERS OF MAP AMENDMENT RECEIVED – HASKELL  AVENUE AREA

    Clerk Offers informed the board that four additional Letters of Map Amendment (LOMA’s) have been received to date for the Haskell Avenue area.  Property located at 111 Liberty Street – Marie Schuyler  is removed from the flood map.  Properties located at 28 Haskell Avenue – Doris Downey and 4 Glenwood Drive – Cathy Reynolds remain in the flood map.  Property located at 36 Haskell Avenue - David and Sandra Owens was out.

    TENTATIVE EQUALIZATION RATE

    Clerk Offers informed the board that the Tentative State Equalization Rate of 101.20 has been received from the State Board of Real Property Services.  Last year’s rate was 70.89.

    EMPLOYEE ASSISTANCE PROGRAM

    Currently the Village carries any employee who has a CDL license under  the Employee Assistance Program at a cost of $16.25 per person per year.  There have been requests from other employees to also have this service.  After discussion a motion was made by  Deputy Mayor Miller, seconded by Mayor Doster and unanimously carried the Employee Assistance Program will be open to all employees who do not require a CDL license for the performance of their job on a voluntary basis and must reimburse the yearly fee to the Village.

    TELEPHONE BILLSs

    Superintendent of Public Works informed the board that the Village can reduce the amount paid for local calling by 15% through DFT Select One.  Three references have been contacted and are satisfied with the service.  After discussion the Mayor will assist the Superintendent in preparing a bid package to be reviewed at the next meeting.

    LEGISLATIVE MEETING

    Motion by Mayor Doster, seconded by Trustee Wood and unanimously carried the Mayor and Trustees be granted permission to attend NYCOM’s Legislative Meeting on November 13, 2000 in Albany, New York.

    BUDGET ADJUSTMENTS

    Motion by Mayor Doster, seconded by Deputy Mayor Miller and unanimously carried that the following budget adjustments be approved as requested by the Clerk-Treasurer:

    AUDIT BILLS

    Motion by Mayor Doster, seconded by Deputy Mayor Miller and unanimously carried the Village bills be audited and paid and that the clerk be granted permission to transfer funds from the money market accounts to the checking accounts to cover such bills.

    MAYOR AND TRUSTEE ITEMS

    Power outage scheduled for October 29, 2000 from 7:00 am to 3:00  pm.  The fire hall will be open with heat and lights during the outage.  The Firemen's auxilliary will be hosting a pancake breakfast that morning and there will be bus service available  for those that need transportation.

    When will the West Street bridge be paved?  Should be a slippery  when wet sign installed.  Contact Supervisor Doug Berwanger.

    Mayor Doster has received a Certificate of Achievement from the US  Department of Housing and Urban Development for providing enhanced economic opportunities and a better quality of life in our community through outstanding performance with HUD's Small Cities  Community Development Block Grant Program in New York State.

    WORKSHOPS

    Motion by Mayor Doster, seconded by Trustee Wood and unanimously carried the Mayor, Trustees, Clerk-Treasurer, Deputy Clerk-Treasurer and Superintendent of Public Works be granted permission to attend a satellite teleconference "The Key to Intermunicipal  Cooperation" in Warsaw on Wednesday, October 25, 2000 sponsored by the New York State Office of the State Comptroller Division of Municipal Affairs.

    Motion by Mayor Doster, seconded by Deputy Mayor Miller and unanimously carried the Mayor, Trustees, Clerk-Treasurer, Planning Board, Zoning Board of Appeals, Secretary to the Boards and the Zoning Officer be granted permission to attend the Fall 2000 Regional Local Government Workshop in Mt. Morris, New York on Friday December 8, 2000 sponsored by the Genesee/Finger Lakes Regional Planning Council.

    REPORTS RECEIVED
