At a regular meeting of the Board of Trustees of the Village of Arcade, Wyoming County, New York held on Tuesday, November 21, 2000, at 7:00 P.M. there were:

NOTICE

Pursuant to Article 7 of the Public Officers Law, notice of this meeting was given to the media on the 9th day of November 2000 and the same posted on the 9th day of November 2000.

APPROVE MINUTES

Motion by Trustee Barber seconded by Deputy Mayor Miller and unanimously carried the minutes from a regular meeting held on November 7, 2000 be approved as presented.

AWARD BID – SNOW PLOW

Motion made by Deputy Mayor Miller, seconded by Mayor Doster and unanimously carried the bid for a snow plow be awarded to Fleet Maintenance, Inc. from West Seneca, New York in the amount of $81,500.00 on a two year lease with equal payments of $42,071.12 upon replacement of hydraulic motor at no charge.

PERMISSION TO ADVERTISE SALE OF SURPLUS EQUIPMENT

Motion by Mayor Doster, seconded by Trustee Wood and unanimously carried Superintendent Kilburn be granted permission to advertise the sale of the old dump truck (truck #28) by sealed bid.

DISCUSS PROPOSED AMENDED DEFINITION FOR HOME OCCUPATION

The board reviewed the proposed amended definition for home occupation prepared by Zoning Officer Marvin Zielonka and Clerk Joanne Offers and made some minor changes.  The amended  definition reads as follows:

Section 202-2.34  HOME OCCUPATION - An accessory use of a dwelling and/or an existing building (e.g. garage), by the resident owner (no employees), which is clearly secondary to the use  of the dwelling for living purposes.  Such use shall not change the essential residential character of the building nor shall there be any exterior evidence of such secondary use other than a small name plate (Section 202.2.76), as herein defined.  All home occupations must adhere to Section 803 Off-Street Parking.  A home occupation shall emit no offensive noise, vibration, smoke, dust, odors, heat or  glare.  Such service, crafts, recognized hobbies and seasonal uses, as listed below, may be considered under this Section.  All applications for a "HOME OCCUPATION" must be submitted for approval for a SPECIAL USE PERMIT, which will be reviewed by the Village Planning Board who will determine if the Application fulfills the requirements, and grant or deny the Application on said basis.  The SPECIAL USE  PERMIT is reviewable and revocable with cause.

 SERVICE:  Physician, surgeon, dentist, accountant, musical instructor, psychologist, physical therapist, lawyer, printer, beautician, interior decorator, engraver.

  • CRAFTS:  Needle work, decorative crafts, candle making, ceramics, small wood working articles intended as decorations.
  • HOBBIES:  Model trains, model cars, model boats, sports cards, photography.
  • SEASONAL:  Fishing supplies (disposable), bait, line lures bobbers, reels, poles, tackle, golf clubs and repairs, deer processing, produce grown on site only.
  • Within a one-year period, any home occupation operating without a Special Use Permit must apply.

Motion by Trustee Wood, seconded by Mayor Doster and unanimously carried the proposed amendment to the definition for Home Occupation be submitted to the Wyoming County Planning Board and  the Arcade Planning Board for their review and comment.

FINAL STATE EQUALIZATION RATE

Clerk Offers informed the Board that the Village has received the Certificate of the Final State Equalization Rate from the State Board of Real Property Tax for the 2000 Assessment Roll of 101.20 which was the same as the tentative.

TENTATIVE SPECIAL FRANCHISE ASSESSMENT

Clerk Offers informed the Board that the Village has received the Notice of Tentative Special Franchise Assessments from the State Board of Real Property Services.  The tentative amount is $998,850, last year the amount was $1,037,731.

BUDGET ADJUSTMENTS

Motion by Deputy Mayor Miller seconded by Mayor Doster and unanimously carried the following budget adjustment be approved as presented by the Clerk

AUDIT BILLS

Motion by Mayor Doster seconded by Deputy Mayor Miller and unanimously carried the Village bills be audited and paid and that the clerk be granted permission to transfer funds from the money market accounts to the checking accounts to cover such bills.

EXECUTIVE SESSION

Motion by Trustee Wood, seconded by Mayor Doster and unanimously carried the board enter executive session to discuss the application of Melissa Parker for Part-time Police Officer.

Motion by Mayor Doster, seconded by Trustee Wood and unanimously carried the board exit executive session.

PART-TIME POLICE OFFICER

Motion by Deputy Mayor Miller, seconded by Trustee Wood and unanimously carried Melissa Parker be hired for the 4th Part-time Police Officer position effective November 27, 2000 at $11.05 per hour and that the Village of Arcade will not be responsible to pay for any academy requirements.

REPORTS RECEIVED

Ambulance report for the month of October was received, reviewed and placed on file.
